Commission on Local Government Boundary Change Reports July 16, 2013

Commission’s Report Commission issues a boundary change report every July for the prior calendar year. local-government/reports.html#Boundary-Change- Reports Report includes all known boundary changes, area annexed and estimated population annexed.

Boundary Changes in VA There are many processes to change a boundary in Virginia. Most boundary change processes require review from the Commission on Local Government. However, if the two jurisdictions involved agree to a relocated boundary with no strings attached, then all that is required is to petition the Circuit Court. This is how most boundary issues are settled in Virginia.

Following Court Approval… § Petition and hearing; recordation of order; costs. …Whenever such an order is entered, a certified copy of the order shall be sent to the Secretary of the Commonwealth by the clerk of the court. § Collection of information relevant to boundary changes from governmental subdivisions of Commonwealth. The Secretary of the Commonwealth shall be responsible for the collection from the governmental subdivisions of the Commonwealth of information relevant to their boundary changes and the dissemination of such information to the appropriate departments of state government.

The Secretary of the Commonwealth then disseminates this information to various state agencies, including the Commission on Local Government. Many agencies use this data to assist in allocation of state aid. Commission uses this to create its report.

Recurring Issues with Current Process Many changes go unreported and are discovered through Newsbank & Google. Population not included in the request to the Secretary. Inadequate property description/plat to digitize. All of these require staff to contact the locality for information or to remind them to get filing certified.

Additional Issues Staff has begun digitizing the boundaries of adjusted boundaries for the last several years. Keeping as a separate shapefile for now. Not worth merging with existing administrative boundaries because of the poor quality of that data.
