Free Forum 2 – Reform of IAACA Conferences and Seminars Rapporteur : Michael Burley IMS Principal Investigator Independent Commission Against Corruption Hong Kong Special Administrative Region, PRC

Reform of IAACA Conferences & Seminars Chairman : Dr. Eduardo Vetere, VP of IAACA Explained to delegates that the successive work of IAACA. The seminars and accompanying workshops had taken as the theme of the chapters of the UNCAC. In October the final part of affording technical assistance under Chapter 6 of the UNCAC will be discussed in Malaysia.

Reform of IAACA Conferences & Seminars Chairman : Dr. Eduardo Vetere, VP of IAACA Explained the history of IAACA and that Conferences and Seminars to date followed Chapters in the UNCAC Invited comments on the future form of IAACA conferences and seminars. Ask for suggestions as to what could be the major topics for consideration at future conferences and seminars. He then opened up the discussion to delegates.

Suggestions & comments from participants Each workshop should given a specific theme and the issues dealt with thematically and be germane to a particular part of asset recovery. More focused issues should be discussed and be practical, drawing where possible on individual experiences. Sharing of real case experiences, both successful and unsuccessful

Suggestions & comments from participants (Cont’d) Issues of concern for discussion could be that Asset recovery is time consuming and how to improve MLA assistance MLA. Set time frame for an initial response, especially if the requested jurisdiction can’t assist in the request. Agreed that a requested jurisdiction should assist in a timely manner The requesting jurisdiction: giving as much detailed/specific information

UNCAC : the only convention gives focus to Asset Recovery. Asset  victim jurisdiction (UNCAC : legal instrument) Future seminars could benefit from experience sharing by giving examples of cases which are successful and cases that were not. Suggestions & comments from participants (Cont’d)

Can IAACA assist by acting as a liaison point between jurisdictions that are members of the IAACA and possibly act as a coordinator in that regard Good and practical idea. Specific details necessary Conferences / functions of State parties under the UNCAC have open forums in order that experiences can be shared and solutions can be sought.

Suggestions & comments from participants (Cont’d) Meeting facilities for individual / small groups of delegates on specific issues germane to them. Report of the deliberations or outcomes published Conferences/seminars specific to prosecutors and investigators and held domestically, nationally and internationally. A Declaration is adopted The Chairman pointed out several problems in producing such as report, one being that multiple language translations would be needed. The IAACA work plan includes more direct training

Suggestions & comments from participants (Cont’d) Speakers’ notes be collected and published in a booklet for deliegates’ reference during the conference Rapporteurs’ reports : multiple languages “Requirements” on the theme topic  more focus Good idea. Presentations are supplied to Chairs of workshops but feasibility of circulating amongst delegates will be considered. Supported the publication of a conference book. But multiple translations could be difficult.
