KEY FIGURES Ed Welby- Paul Welby’s father ; Provided 2 minors with alcohol. Jean Welby- Paul’s mother ; had previously given boys permission to drive her car. Paul Welby- Son ; Was given permission to drive that night ; knew he was intoxicated when he drove. Neal & Ellen Foley- Parent’s of Danny Foley ; Suing the Foley’s for allowing their son to drink & then allow Paul to drive. Danny Foley- Friend of Paul Welby ; Had champagne with the Foley’s ; Severely injured in wreck. Police Officer- Witnesses wreck ; tried to pull them over. Neal & Ellen Foley

EVENTS The Foley’s gave 2 minors alcohol & then allowed them to drive to a party. The injuries to Danny that came from the wreck.

FACTS Ed Welby come home to celebrate his promotion Ed brought home champagne and gave some to his wife, son, and his son’s friend. Ed and Jean Welby had given the boys permission to drive to a party that night. After dinner Ed and Jean walked to a friend’s house to celebrate some more and they forgot that they gave the boys permission to drive that night. The boys finished off the alcohol before leaving for the party. Paul drove to the party. He was going 78 mph in a 55 mph speed limit. A police officer saw them speeding and tried to pull them over. Paul tried to pull over without slowing down and hit a pole. Danny was thrown from the vehicle. Paul had a concussion and a few scratches and bruises. Danny broke his spine and had multiple head injuries. Paul Welby (17)

FACTS CONTINUED Danny now lives in a nursing home. He has to be fed through a tube. Has been in a coma since the accident. Foley’s have went bankrupt because of Danny’s hospital and nursing home bills. Paul was fined $700 and had his licensed suspended for three months. The Foley’s are suing the Welby’s for giving the underage boys alcohol and then allowing them to drive, which cause Danny’s injuries. Danny Foley (16)

AFFIDAVITS AND DEPOSITIONS Ed and Jean Welby admits to buying the champagne and allowing Paul and Danny to have a few glasses. Ed Welby admits to letting his son, Paul Welby, have a few beers with him when they go fishing. Ed and Jean Welby also admits to knowing that Paul had alcohol sometimes at parties, but that he never got drunk.

LAWS REGARDING DRINKING & DRIVING Any state, U.S.A. Statute: Persons under 21; illegal acts related to alcohol  Subdivision 1. Consumption  Subdivision 2. Purchasing and providing  Subdivision 3. Possession  Subdivision 4. Driving under the influence of alcohol by a minor  Any state, U.S.A. Statute: Social host liability and underage drinking Both of these Statutes’ state that it is illegal to give minors alcohol, and also that it is illegal to drive while intoxicated. Both also state that the adult who gave the minor alcohol will be held responsible for any damages or injury that takes place while that minor is under the influence

OUTCOME We believe that Ed and Jean Welby should be held accountable for giving two minors champagne. It is illegal for minors to consume or even have alcohol. Ed and Jean knew the laws and knew exactly what they were doing.
