LEGISLATIVE FRAMEWORK Government of the Republic of Serbia-Public Procurement Office LEGISLATIVE FRAMEWORK Public Procurement System was set up in Serbia by adoption of Public Procurement Law (PPL) in the year 2002. Significant amendments of the PPL happened in 2004. Existing PPL entered into force in the beginning of the year 2009. Apart of PPL there are a set of 10 bylaws that define concrete segments of PP in more detailed way, including e-procurement

PUBLIC PROCUREMENT OFFICE Government of the Republic of Serbia-Public Procurement Office PUBLIC PROCUREMENT OFFICE Essential tasks of the PPO are: Participation in drafting the regulations Providing consultancy services to CA and bidders Monitoring of public procurement procedures Issuance of certificates to public procurement officers Preparation of model decisions and other acts the procuring entity adopts in public procurement procedures Publication and distribution of relevant expert literature Collection of statistical and other data on public procurement Formation and maintenance of the Public Procurement Portal Cooperation with foreign institutions and experts in the field of public procurement

GENERAL DATA ON PROCUREMENT MARKET IN SERBIA Government of the Republic of Serbia-Public Procurement Office GENERAL DATA ON PROCUREMENT MARKET IN SERBIA It is estimated that there are approx.12.000 CA and approx. 80.000 bidders in Serbia Official statistics for the year 2011: Total number of concluded PP contracts: 111.249 Total value of concluded PP contracts: 2,8 billion EUR PP on annual level amounts approx. 10% of Gross Domestic Product (GDP)

Government of the Republic of Serbia-Public Procurement Office E-PROCUREMENT EXISTING PPL ENVISAGES: Possibility of submission of bids electronically, if it was envisaged by CA in the tender documents E- auction as instrument for competition among bidders There is a specific Rulebook (a bylaw) that regulates in details how to treat e-bids, as well as the way to conduct e-auctions However, in practice, the mechanisms aren’t being used yet

PUBLIC PROCUREMETN WEB-PORTAL Government of the Republic of Serbia-Public Procurement Office PUBLIC PROCUREMETN WEB-PORTAL One of the key novelties envisaged by the PPL adopted in 2009. godine is introduction of Public Procurement Portal as unique instrument for improving transparency and information-access increase for CAs, bidders and other stakeholders PPL defines that the PPO is in charge for establishment and maintenance of PP Portal, which represents one of its key activities PPO’s Portal becomes operational in the beginning of 2008, but it became fully operational in 2009, by entering into force of the new PPL

PUBLIC PROCUREMETN WEB-PORTAL Government of the Republic of Serbia-Public Procurement Office PUBLIC PROCUREMETN WEB-PORTAL PPL ENVISAGES: Mandatory, free-of-charge publishing of large-value PP advertisements, beyond 30.000 EUR, instead previous commercial publishing in a daily newspapers Mandatory publishing of decision of Republican Commission for Protection of Rights in PP Procedures Mandatory publishing of CAs’ quarterly reports on conducted PP procedures and concluded PP contracts Possibility for publishing of small-value procurement Possibility for publishing tender documents

PUBLIC PROCUREMENT WEB-PORTAL Government of the Republic of Serbia-Public Procurement Office PUBLIC PROCUREMENT WEB-PORTAL All listed obligations and predicted possibilities for publishing are supported/operational on the Portal THE LATEST STATISTICS RELATET TO PORTAL Total number registrated CAs: 2.531 Total number of published advertisements: 133.000 (50.000 contract notices) Total number of published decisions of the Republican Commission: 2.300 Total number of published concluded large-value PP contracts taken from CAs’ quarterly reports: 160.000 Average number of published PP tenders daily: 80 Average number of visits daily: 700 Total savings of public resources due to free publishing: 20 million EUR

The Danish twinning partner has given the following recommendations: Serbia has taken steps to ensure further development of eProcurement The legal framework is in place to perform eTendering There is a well-functioning eNotification platform, the PPO web portal It could be necessary to build a tehnical link between the eNotification platform and eTendering platforms

Government of the Republic of Serbia-Public Procurement Office STRATEGY FOR DEVELOPMENT OF PUBLIC PROCUREMENT IN SERBIA – MEASURES FOR IMPROVEMENT To broaden the role of PP Portal in direction of centralized support to electronic PP: To introduce CPV To enable publishing of notices in procedures conducted by international organizations To set up a unique registration system for bidders To improve the searching system by enabling to the bidders to be informed about the published notices automatically To improve the call center for giving services related to use of the Portal To introduce mandatory publishing of: small-value procurement, tender documents, annual procurement plans of CA

Government of the Republic of Serbia-Public Procurement Office STRATEGY FOR DEVELOPMENT OF PUBLIC PROCUREMENT IN SERBIA – MEASURES FOR IMPROVEMENT Design a way of distribution of the documents to bidders , and enable networking of the institutions responsible for issuance of the documents Implement a pilot project in the field of e-tendering and e-purchasing, with chosen participants and for defined subjects of procurement Joining of Serbia to the group of countries members of PEPPOL project that is being implemented within an EU program (ICT PSP) Action plan envisages end of 2014. as deadline for implementation of proposed measures
