340 B in New Mexico Initial interest – 2001 interim Aggressive Rx agenda beginning 2002 Joint Memorial: Requesting the Medicaid program and other relevant departments to “identify all avenues to maximize “ use of the 340B drug discount program Called for a report to the interim Legislative Health & Human Services Committee

340 B in New Mexico Medicaid Reform Committee – 2002 interim Created by statute to identify ways to control escalating costs in Medicaid Prescription drugs a significant focus Statute required the department to make reasonable efforts to assist eligible entities to enroll in the 340B program, and To assure that enrolled entities bill Medicaid at the 340B purchase price

340B in New Mexico 2003 Interim – again addressed prescription drugs Medicaid reform statute not fully implemented Interim committee endorsed a mandate re: 340B H88, introduced in 2004 session, required all eligible entities to enroll in the program

340B in New Mexico: Other Initiatives Legislative Health & Human Services Committee has explored extending 340B to prisons Greater use in primary care clinics sought Use by other departments of state government is being encouraged Monitoring status and effectiveness in New Mexico hospitals, and savings to the Medicaid program

Summary & Conclusion New Mexico has been very proactive in passing prescription drug legislation that will: 1.) reduce the cost of prescription drugs to consumers; and 2.) reduce the cost of prescription drugs to the state  We are beginning to see very positive results  We will continue to monitor implementation of the statutes, and to pursue extension of this valuable program to other parts of state government
