2 Where Have We Been?: 1993 WEDI calls for transactions use legislation 1996 Congress passes HIPAA Administrative Simplification 1998 Transactions and Code Sets NPRM published 1998 Standard Provider Identifier NPRM published 2000 Transactions and Code Sets Final Rule published 2002 Administrative Simplification Compliance Act (ASCA) 2003 Transaction Contingency Permitted 2004 Many covered entities utilizing the Claims Attachments NPRM Expected 2005 e-Prescribing NPRM published

– 2008 Challenges Many still view HPAA as a compliance issue, ignoring: –Acknowledgements –Business Rules for eligibility and benefits –Interoperability for security and data –The black holes (without acknowledgement) Many still limited by: –Legacy systems –Vendors that only support HIPAA requirements –Focusing on doing the least possible to comply –No national health plan identifier –The need to build consensus and act on how to identify individuals

Major Milestones CMS will start issuing NPIs WEDI to recommend industry action on acknowledgements CAQH/WEDI are promoting collaboration to develop eligibility and benefit Business Rules HIPAA Security Rule compliance date April 21, 2005

6 How Does Differ From ? We are getting past the “claims” focus Recognition of the need for security and data interoperability (web services) Recognition of the need for Business Rules Recognition of the need for acknowledgements Industry, with government, is working to implement acknowledgements and business rules without regulations requiring them E-prescribing RHIOs “Those who are only interested in minimum compliance will be left behind.” Lazarus, 2005
