Planning & Community Development Department Background September 2014  In response to growing community concerns, the City Council directed staff to develop a strategy to address “mansionization”  Staff worked with the Planning Commission to develop a three- phase approach;  Phase 1 – Lower Hastings Ranch  Phase 2 – Non-Hillside, Non-Historic Single Family residential zones  Phase 3 – Hillside Overlay zones 2

Planning & Community Development Department Work Plan Based on the community outreach effort and timing for Phase 1, staff has revised the work plan as follows:  Phase 1 – Completed by April 2016  Phases 2 and 3 – To be undertaken concurrently; completed by September JAN 2016 PHASE 3 SEPT 2016 APR 2016 PHASE 2 PHASE 1 DEC 2016

Planning & Community Development Department Moratorium Timeline March 2, 2015 – Ordinance No was adopted by City Council, placing a moratorium for 45 days on new construction in Lower Hastings Ranch. April 13, 2015 – Ordinance No was adopted by City Council, extending the original moratorium for an additional 10 months and 15 days. 5

Planning & Community Development Department Moratorium Restrictions The moratorium currently prohibits:  Demolition of more than 50% of exterior walls of a structure;  Second-story development or second-story additions of any size;  Single-story additions that increase gross floor area by more than 500 square feet or 20% of the existing floor area of the primary structure (whichever is greater);  Single-story detached accessory structures larger than 20% of the existing floor area of the primary structure. 6

Planning & Community Development Department Outreach – Phase 1 December 2014  Staff held a neighborhood meeting at the Hastings Ranch Library where residents expressed their desire for a moratorium.  Staff mailed a survey to residents to better understand areas of concern. March 2015  In response to neighborhood concern regarding new construction that was thought to be out of scale and/or out of character in Lower Hastings Ranch, a moratorium on certain types of single family development was adopted by the City Council.  The moratorium is designed to protect the Lower Hastings Ranch neighborhood from inappropriate development until new regulations are in place. 7

Planning & Community Development Department Outreach – Phase 1 July 2015  Staff met with members of the Lower Hastings Ranch Association Board to obtain input on areas of concern. September 2015  Lower Hastings Ranch Association Board and Neighborhood workshops to present conceptual code changes and obtain feedback.  Study Session with the Planning Commission. 9

Planning & Community Development Department Outreach – Phase 1 November 2015  Solicitation process begins for consultant to assist in developing regulations and guidelines. January 2016  Follow-up survey released to residents to obtain more detailed feedback on possible code changes. 10

Planning & Community Development Department Next Steps – Phase 1 February-March 2016  Community Workshop to finalize proposed regulations. March 2016  Permanent regulations for Lower Hastings Ranch brought forward for adoption. 11

Planning & Community Development Department Moratorium Extension The existing moratorium is set to expire on March 4, State law permits a final extension of the moratorium for one year, setting the new expiration date to March 4, Staff is in the final stages of developing new regulations to address neighborhood concerns, anticipated to be in effect by Spring  While permanent regulations are anticipated to be in effect by Spring, extension of the current moratorium will ensure that neighborhood protection remains in place until that time. The moratorium will be repealed once permanent regulations take effect. 12

Planning & Community Development Department Moratorium Extension It is recommended that the City Council:  Find that the proposed extension is exempt from the California Environmental Quality Act (CEQA Guidelines Sections 15061(b)(3) and 15262;  Find that there is a current and immediate threat to public health, safety and welfare pursuant to the standards and policies set forth in the General Plan and that there has been a change in circumstances since the adoption of Ordinance #6380 as discussed in Ordinance #7256; and  Adopt an urgency ordinance extending Ordinance #7256 to March 4,
