Utility Communicators International BGE’s Rethinking Drinking Program June 2014

Applicable Law Impacting CDL Drivers  49 CFR Part established major offenses for CDL holder in personal vehicle which included: – Refusal to be tested for alcohol or drugs – Under influence of alcohol as prescribed by State law – Leaving scene of accident  On first conviction for a major offense, CDL holders must be disqualified for one year  Effective date July 5, 2005 Federal Level  Effective in Maryland September 30,

Opportunity for Change at BGE  Approximately 2,500 authorized BGE, including 1,200 CDL drivers.  In a 19-month period ( ), there were 26 authorized drivers charged with impaired driving in their personal vehicles causing them to lose BGE driving privileges.  Employees and leaders were not fully aware of the company’s expectations and/or consequences for impaired driving violations.  Lack of clear guidelines and consistent treatment were resulting in disruption to operations, safety concerns and potential liability for the company. 3

Objectives Create awareness about the increasing trend of DUIs at BGE Reduce the number of impaired driving charges by promoting prevention Educate employees on the personal and professional consequences of driving while impaired Introduce the new impaired driving policy 4

Policy Overview  Established immediate termination criteria – Is an introductory employee or trainee or; – Was charged during employee’s working hours or while representing the company outside of regular working hours (company or personal vehicle) or; – Was charged while driving a company-owned or leased vehicle or; – Has a prior conviction for an impaired driving offense within last five years or; – Failed to self-report in accordance with company policy 5

Policy Highlights  Established modified driving responsibilities criteria – Most recent year-end review documents solid or better performance – Employee may not currently be on probation as the result of a corrective action – Two-year review of state driving history demonstrates acceptable driving behavior without unsafe patterns of behavior – Two-year review of company record must be clear of preventable motor vehicle incidents – Business leader has the ability to modify driving responsibilities in same or lower graded job without disrupting business operations – Driving modifications must be approved at the VP level – Employee is responsible for obtaining reinstatement company driving privileges as follows: o 6 months for non-CDL o 18 months for CDL 6
