Timely and Meaningful Consultation Berwyn South School District 100

In this session you will: Learn how the Child Find Process is used with parentally placed or home schooled children. Collaborate to determine what proportionate share services District 100 will provide to students identified as having a disability.

Proportionate Share: A Brief History Since the passage of IDEA 1997, school districts have been required to allocate a “proportionate share” of their Federal IDEA Part B funds to provide private school students the opportunity to “equitably participate” in special education programs offered by the district.

The Big Shift: IDEA 2004 IDEA 1997: responsibility for providing proportionate share rests upon the resident district of the private school student. IDEA 2004: responsibility for providing proportionate share rests upon the district in which the student attends school, regardless of residency.

Who’s Included? Students who have or may have a disabling condition and who are placed by their parents in a private elementary or secondary school. Home-schoolers of elementary or secondary school age.

Why Home-Schoolers? People v. Levisen: Illinois Supreme Court (1950) – Home school equals private school. ISBE supplemental to Memo 05-7: home schoolers are to be included within the category of students entitled to receive proportionate share services.

Determining Funding Proportionate share funds are given to districts from ISBE. The amount of money per year is based on enrollment from private schools. Approximate amount for (based on ) amount: $9,837

Child Find Procedures When a private school has concerns about a student, they fill out a “Statement of Need” and provide information about the student, including concerns to District 100. The Statement of Need should not be sent to the district without the private school meeting with parents and sharing their concerns. Upon receipt of a Statement of Need, a District 100 representative will contact the teacher in order to set up a meeting to discuss the particular student.

Child Find Procedures, Cont. Based on the information discussed at the meeting, the team will determine the appropriate next steps. Next steps could include: –Suggestions for modifications and accommodations the school could provide. –A screening completed by a D100 service provider to determine whether or not the student requires a full evaluation. –A full case-study evaluation to determine if the student is eligible for special education services.

Once a Student is Found Eligible Parents have to determine whether or not they want to un-enroll their child and place them in the public school. Parentally placed children do not have an individual entitlement to any or all of the services that the children would receive if enrolled in a public school. Children in public schools who are found eligible for special education services have an Individualized Education Plan (IEP). Children that are eligible for services, but parents continue to place their child at a private school are eligible for a service plan. IEPs are more comprehensive and students within the public school are normally entitled to more services.

Services Provided in the Past In the past, District 100 has provided Speech and Language Therapy for parentally placed students since this is the most common concern presented. We have also provided transportation for students to and from the private school in order to receive services at a District 100 school, provided by a Speech and Language Pathologist. Speech and language therapy is billed at $60/hour. When proportionate share funds are used, the district is not entitled to continue services throughout the school year.

Complaint Process If District 100 disagrees with the views of the private school officials on the provision of services, types of services, etc., the Local Educational Agency (LEA) will provide the private school officials a written explanation of the reasons why we have chose not to provide services. If there are concerns about the consultation today in regards to it not being meaningful, or that views were not given due consideration by District 100, a complaint can be made wit the Illinois State Board of Education.
