Title 39 Regulations  New Jersey Statutes Annotated 39:4-8a “Except as otherwise provided in this section, no ordinance or resolution concerning, regulating or governing traffic or traffic conditions, adopted or enacted by any board or body having jurisdiction over highways, shall be of any force or effect unless the same is approved by the Commissioner of Transportation, according to law. The commissioner shall not be required to approve any such ordinance, resolution or regulation, unless, after investigation by him, the same shall appear to be in the interest of safety and the expedition of traffic on the public highways.”

Approval Optional  Speed Limits  No Passing Zones  Mid-Block Cross Walks and Crosswalks  Stop Intersections  Multi-Way Stops  Yield Intersections  Centerlines  Edgelines  Municipalities MAY submit these for the Commissioner’s Approval Under NJSA 39:4-8a OR  Municipalities MAY certify these under NJSA 39:4-8b (1)

Title 39 Regulations  New Jersey Statutes Annotated 39:4-8b Certification Requirements NJSA 39:4-8b (3) requires that items being done under this section be accompanied by the appropriate supporting data, a sealed letter from a Professional Engineer stating that it is approved by him/her after his/her investigation, appears to be in the interest of safety and expedition of traffic and conforms to the MUTCD. This has to be submitted with a certified copy of the adopted ordinance after which DOT has 90 days to reject. Applies to NJSA 39:4-8b (1) a, b & c. Requirements do NOT apply to NJSA 39:4-8b (1) d

Where May Municipalities Certify Traffic Regulations?  Self-Contained Streets NJSA 39:4-8b (1) a – No Passing Zones And Crosswalks NJSA 39:4-8b (1) c – Stop, Yield and Multi-Way Stop Intersections  ANY Municipal Street NJSA 39:4-8b (1) b – Speed Limits NJSA 39:4-8b (1) d – Stop Signs within 500’ of a School, Playground or Youth Recreational Facility

What are “Self-Contained Streets”?  N. J. S. A. 39:4-8b (1) (a) & (c) – “…streets under municipal jurisdiction which are totally self-contained within that municipality and have no direct connection with any street in any other municipality ; …”

What are “Self-Contained Streets”?  Municipal jurisdiction. Not a State Highway. Not County Road.  Does not cross municipal boundary.  No Direct Connection with any Street in Another Municipality.

Self-Contained Streets  Circular Dr., Quiet Ct. & East Ct. Do Not Cross the Municipal Line Do not have a direct connection with any street in another municipality.

What are “Municipal Streets”?  N. J. S. A. 39:4-8b (1) (b) – “…on any street under municipal jurisdiction  N. J. S. A. 39:4-8b (1) (d) – “designate any intersection as a stop intersection and erect appropriate signs, on streets under municipal jurisdiction if that intersection is located within 500 feet of a school, or of a playground or youth recreational facility and the street on which the stop sign will be erected is contiguous to that school, or playground or youth recreational facility. …”

Provisions of NJSA 39:4-8b(1) d  The municipal engineer shall certify to the following in regard to the designated site in which a stop intersection is being designated: (i) that both intersecting streets are under municipal jurisdiction; (ii) that the intersection is within 500 feet of a school, or of a playground or youth recreational facility as defined herein; and (iii) that the intersection is on a street contiguous to a school, or playground or youth recreational facility.

Using 39:4-8b (1) Will:  Expedite Your Requests  Save D.O.T. Some Time, Too Hundreds of Requests Pending Stop Sign, Multi-Way Stops, And Speed Limit Investigations Are Most Asked For Requests

A Rose is A Rose  39:4-8b Submission contains the following: Adopted Certified Municipal Ordinance or Resolution Appropriate Supporting Data PE Sealed Engineers Certification that the Traffic Regulation is in the interest of “safety and expedition of traffic” Traffic Control Devices Conform to the MUTCD  Even if Submitted for DOT Approval

Acknowledgement or Rejection  NJDOT has 90 days to Reject  BTEI will Acknowledge ASAP if not rejecting Not an Approval “Keep on Record for Future Reference” NJ Administrative Code 16: “Certification of Traffic Control Devices”  BTEI Rejection if Recommended Traffic Regulation is not Supported by Submitted Data

No DOT Approval Required  NJSA 39:4-8c  By ordinance or resolution: (1) Prohibit or Restrict General Parking; (2) Designate Handicapped Parking for a Resident (3) Designate Time Limit Parking; (4) Install Parking Meters.  By ordinance, resolution or regulations (1) Designate Loading and Unloading Zones and Taxi Stands; (2) Approve Street Closings for Periods up to 48 Continuous Hours; (3) Designate Handicapped Parking.

Municipal Bus Stops  NJSA 39:4-8e  A Municipality … may, by resolution, in any street under its jurisdiction, designate stops, stations or stands for omnibuses.  The designation shall be subject to guidelines that shall be issued by the Commissioner of Transportation.  The commissioner, at his discretion, may invalidate the provisions of the ordinance or resolution within 90 days of receipt of the certified copy if he reviews it and finds that the provisions of the ordinance or resolution are inconsistent with the guidelines issued pursuant to this subsection.
