© copyright Pumptronics Europe LTD 2016 PT/PR-03 V4 Legal background  ATEX 137 (EU Directive 99/92) concerns worker health and safety in those workplaces where potentially explosive atmospheres may be present  This user ATEX 137 Directive, is implemented in the UK by Health & Safety Executive (HSE) under The Dangerous Substances and Explosive Atmospheres Regulations 2002 (DSEAR).  The Dangerous Substances and Explosive Atmospheres Regulations 2002 (DSEAR) sets minimum requirements for the protection of workers from fire and explosion risks related to dangerous substances and potentially explosive atmospheres.  Due to its flashpoint being relatively high, diesel has not been caught under DSEAR (i.e. was not classed as a "dangerous substance"). 3

© copyright Pumptronics Europe LTD 2016 PT/PR-03 V4 Legal background cont.:  From 1 st June 2015, the classification of diesel (EN 590) and similar fuel oils changed pursuant to the CLP Regulation Classification, Labelling and Packaging (EU regulation 1272/2008 which is seeking to move the EU towards a globally harmonised system of classification and labelling of substances and mixtures).  It follows that, as of 1 st June 2015, the upper flashpoint for flammable liquid increased from 55°C to 60°C, and, as a result, diesel, along with other similar fuel oils, is now classified as a flammable liquid. © copyright Pumptronics Europe LTD 2016 PT/PR-03 V4 Enforcement from HSE web site  The ATEX Directives and DSEAR Regulations are enforced in UK by HSE and, in some circumstances, DSEAR is enforced by others (e.g. local authorities and petroleum enforcement authorities).  In cases that involve environmental hazards, the Environment Agency and the Scottish Protection Agency, provide technical and scientific support. 5

© copyright Pumptronics Europe LTD 2016 PT/PR-03 V4 APEA Bulletin June article  The APEA’s June Bulletin magazine (Association for Petroleum and Explosives Administration, and joint publishers of the industry “Blue Book”) produced an article highlighting the need for ATEX certification for diesel dispensers which is partially reproduced here.  All equipment used for pumping diesel must bear CE marking (and have a relevant EC Declaration of Conformity).  In order to apply a CE marking, the manufacturer of such equipment must assess all risks and the need for compliance to all applicable directives BEFORE applying such CE marking and signing the associated Declaration of Conformity.  The change in classification of diesel may affect many commercial pump manufacturers and users of equipment. 6

© copyright Pumptronics Europe LTD 2016 PT/PR-03 V4 APEA Bulletin June article: cont.  Even if the site owner considers his premises to be perfectly safe, the pump manufacturer needs to make sure equipment is “suitable for use”.  ATEX applies only if one (or both) of the below conditions is fulfilled  Equipment will be placed in an ATEX hazardous zone. Equipment need to be compliant with type of danger and zone, and compatibility zoning established in relevant documentation  Equipment carries/brings an ATEX hazard. Equipment needs to be protected, zoning established and compatibility zoning established in relevant documentation 7

© copyright Pumptronics Europe LTD 2016 PT/PR-03 V4 APEA Bulletin June article: cont.  With Diesel now being categorised as flammable the requirements of the ATEX Directive (ATEX 94/9/EC) apply. As The Bulletin explained, the EU directive approach is to:  Check how dangerous such “pumped” substances can be (and refer to Harmonized standard IEC/EN )  See that it complies with ATEX IIA T3  Check the ATEX directive for obligations (including also 10 years archiving, type approval, audits etc.)  And see that dispensers shall be CAT 2 (which means Zone 1 present)  And find that there is a harmonized standard to build such equipment (EN ), allowing for easy certification. 8

(from guidance notes issued by CSA Group parent company of SIRA)  It is the manufactures responsibility to declare conformity. Before doing so he must first consider the following questions.  What is the equipment category  If the product is an internal combustion engine or electrical equipment and is Category 2 or (M)2, then an EC type Examination Certificate issued by a Notified Body will be required.  The manufacturer will also require either a Quality Assurance Notification Certificate issued by a Notified Body or tests specified in a quality plan and agreed by the Notified Body must be carried out 11

© copyright Pumptronics Europe LTD 2016 PT/PR-03 V4  CLP Regulations applied in full from 1 st June 2015 – Harmonising of classification, Labelling and mixtures.  ATEX concerns worker health and safety in those workplaces where potentially explosive atmospheres may be present.  DSEAR – UK implementation of ATEX 137  ATEX 137 & DSEAR Enforced by HSE, Local Authorities and Petroleum Inspectors.  Directive 94/9/EC – also known as ATEX 95 or the ATEX equipment standard – concerning equipment and protective systems intended for use in potentially Explosive Atmospheres  ATEX Categories 1 & 2 (for zone 0 & 1) for Fuel dispensers are specifically required to be Third party approved.  EN defines the safety requirements for construction and performance of metering pumps, dispensers and remote pumping units  EC type Examination Certificate – issued by Notified body confirming the pump complies with the design requirements of the ATEX standard.  ISO/IEC :2011 specifies particular requirements and information for establishing and maintaining a quality system to manufacture Ex equipment.  Quality Assurance Notification Certificate – Quality certificate issued by Notified Body under following a successful and ongoing Quality Audits. 12 Summary of regulations and requirements.
