Background The BCC approved a billboard moratorium on July 28, The moratorium prohibits new billboards within 1,000 ft. of limited access highway ramps, within railroad right-of-way and un-zoned property. The moratorium expires on Jan. 15, 2016 or when new amendments are approved.
Background Billboard Case ZM – Zoning Manager Determination was made to invalidate two billboards approved and built within the railroad right-of- way and SR 429 Expressway. – On June 30, 2015 the BCC reversed the ZM Determination. The BCC determined the billboard placement standards used to make the determination were ambiguous, needed clarification and policy direction. – Main issues: Clarification of distance separation from and within limited access highway ramps Determination if billboards should be allowed in RR ROW Determination if billboards should be allowed in un-zoned property

Proposed Amendments Section (15&16) (15)Any sign placed in a railroad right-of-way, including a billboard, except for a sign erected by the railroad company needed for the operation of the railroad. (16)Any sign placed on property that is not zoned.
Proposed Amendments Section (l) A billboard located within five hundred (500) feet of any toll plaza, structure, or facility of any limited access highway, which five hundred (500) feet shall be measured along the edge of pavement of the limited access highway, shall be set back at least five hundred (500) feet from the edge of the right-of-way of the limited access highway.
Proposed Amendments Section (m)(1) (1)a billboard shall not be located within the area bounded by a limited access highway, a ramp of a limited access highway, and the limited access highway or non-limited access highway that the ramp intersects or merges with, or within the area bounded by a ramp of a limited access highway and the limited access highway or non-limited access highway that the ramp intersects or merges with; and
Proposed Amendments Section (m)(2) (2)a billboard shall be set back at least five hundred (500) feet from the edge of the right-of-way. The setback area shall commence at the point that is five hundred (500) feet beyond one end of a ramp of a limited access highway, continue along the outside edge of the entire length of the ramp, and terminate at the point that is five hundred (500) feet beyond the end of the other ramp. The five hundred (500) foot linear distance from an end of a ramp shall be measured beginning at the gore point of the ramp.

LPA Recommendation LPA held a public hearing on Nov. 19, 2015 and found the ordinance to be consistent with the Comprehensive Plan with one recommendation. Consider additional separation distance from turn lanes associated with off-ramps, beyond the gore point as stated by the City of Winter Garden.
Revised Amendments Section (l) Clarification Language Added A billboard located within five hundred (500) feet of any toll plaza of any limited access highway, and any associated structure or facility, which five hundred (500) feet shall be measured along the edge of pavement of the limited access highway, shall be set back at least five hundred (500) feet from the edge of the right-of-way of the limited access highway.
Revised Amendments Section (m)(2) Clarification/Grammatical Changes (2)a billboard shall be set back at least five hundred (500) feet from the edge of the right-of-way, with the setback area commencing at the point that is five hundred (500) feet beyond one end of a ramp of a limited access highway, continuing along the outside edge of the entire length of the ramp, and terminating at the point that is five hundred (500) feet beyond the end of the other ramp. Revised Amendments There are currently three (3) appendix maps attached to the draft ordinance. Staff has refined the maps and recommends only two (2) illustrations be approved as part of the ordinance.

Requested Action Make a determination that this ordinance will not have a substantial economic impact on development, make a finding that it is consistent with the comprehensive plan, and approve the ordinance as amended today.
