New Program Created The proposed Ordinance would establish a Certificate of Use Program which would be administered by the Planning and Zoning Division. The Program would require businesses to file a Certificate of Use (CLO) application and receive the Certificate before commencing with establishment of the business.

Comprehensive Plan Program The Planning and Zoning Division administers the Comprehensive Planning Program. This Program requires the Division to maintain, periodically review, and revise the Comprehensive Plan as needed. There is no fee for this Program; however, a person desiring to amend the Comprehensive Plan text or Future Land Use Map must pay an application processing fee.

Land Development Regulations Program The Planning and Zoning Division administers the Land Development Regulations (LDR) Program. This Program requires the Division to maintain, periodically review, and revise the LDR as needed. There is no fee for this Program; however, a person desiring to amend the LDR text or Official Zoning District Atlas must pay an application processing fee.

Land Development Order Program The Planning and Zoning Division administers the Land Development Order Program. This program requires the Division to process land development order applications, such as Development Plans, Improvement Plans, Special Exception Uses, Variances, and Zoning Certificates or Determinations. Processing fees are charged for these applications.

COU Processing Fee Proposed The Resolution establishes a fee schedule for processing a Certificate of Use application. The rationale for charging a fee is that the processing of the application is to the benefit of the person submitting the application and not to the public at large.

COU Processing Fee Home occupation processing fee is $10.00 All other businesses is $20.00 If a business opens before a COU application is filed, the processing fee is $40.00 If the filed application is incomplete, then an additional $5.00 processing fee is charged If a business expands or changes its name, a $10.00 processing fee is charged A $5.00 processing fee is charged for a duplicate

Costs covered by the Fee The application fee is intended to partially and not fully cover the costs of the following activities:

Application Intake Intake or receipt of the application, assigning the application a number, and logging the application in an electronic database;

Application Completeness Review Reviewing the application to determine whether the application is complete, which includes: ◘ Ensuring the application is completely filled out and properly executed and notarized; ◘ Ensuring a floor plan is attached; ensuring that all required licenses, certifications, and registrations are attached; ◘ Ensuring verification of garbage collection is provided; and ensuring the list of uses is attached;

Application Processing If the application is complete, the following activities occur: 1.Researching the Future Land Use Map designation of the property and printing the map page; 2.Researching the Official Zoning District Atlas classification for the property and printing the Atlas page; 3.Determining whether the zoning district is consistent with the FLUM designation of the property; 4.Reviewing the application form (Part 2) to determine the land uses that are located on the Premises;

Application Processing (Continued) 5.Determining whether the listed land uses are in conformance with the zoning district of the property; 6.If a special exception use was granted, securing a copy of the resolution and making note of all required conditions; 7.Reviewing the application for conformance to the parking regulations by researching the number of parking spaces shown on the development plan, improvement plan, or by site inspection; and 8.Reviewing the application for conformance with the concurrency requirements.

COU Inspection Fee Proposed The purposes of the COU inspection is to ensure the uses listed by the business on the COU application are accurately stated (e.g., the business address is correct or that a bar is not an adult entertainment business) and to identify whether or not the specific business proposed for this location requires physical improvements (e.g., a public assembly use requires two ingress/egress areas)

COU Inspection Fees A Building COU inspection fee is $25.00 A Fire COU inspection fee is $25.00 A Building or Fire re-inspection fee is $10.00 An Building or Fire COU inspection that results in a conclusion that physical improvements be made are subject to regular inspection fees and not COU inspection fees

Certificate Issuance If an inspection is not needed or if the Premises pass inspections, preparing the certificate of use including any conditions, and then issuing the certificate.
