2 Underlying issues Settlement of ICANN/Verisign litigation or continue until ICANN wins in court Renewal process for registry agreements –If breach of agreement, re-bid the TLD Lack of competition for the.com registry –Switching costs for registrants ICANN funding –Registrars continue to support ICANN –Recognize need for reserve

3 Specific Concerns No ability to adjust registry service approval process for 3 years No review process prior to renewal Ability to raise registry fees in the absence of significant competition ICANN fees that may be passed onto registrars (and hence registrants) without appropriate accountability mechanisms

4 Proposal Settlement –Don’t approve the current settlement until resolve the policy issues involved Renewal –Follow current renewal process –Use policy process to change the renewal process Funding –Review the funding model and develop more efficient budget approval process that provides more certainty for ICANN –Provide more certainty for ICANN - reserve Follow policy process before incorporating changes into contract that have a material impact on third parties
