BRIEF HISTORY This portion of Keene’s Pointe is located in Camden Village and Camden Village Addition, and was approved under separate Preliminary Subdivision Plans (PSP) known as Keene’s Pointe Phase 4B and Camden Addition. This area was designated as Open Space on the Phase 4B PSP. There was no designation of active or passive recreation indicated on the Phase 4B PSP. Therefore this area needed to obtain the appropriate entitlements for such. We contacted Orange County Zoning staff and based on the original direction indicated to us, we could obtain the adjacent 10 homeowners approval of the tot lot in order to avoid a public hearing on this matter. However one resident objected. As stated above, there are approximately 255 home sites.

Each Owner, by accepting title to a Residential Unit and becoming an Owner, acknowledges the Property is being developed as a master planned community, the development of which is likely to extend over many years. Consequently, Declarant (or its successors) may from time to time seek modifications to the master plan. No Owner has any vested right or expectation that the approvals currently applicable to the Property shall not be changed or modified from time to time. Declarant may request changes in (a) zoning, uses or density of the Properties, or (b) any conceptual or master land use plan for the Properties, provided, such revision is or would be lawful (including, but not limited to, lawful by special use permit, variance or the like). Each Owner acknowledges that no representations, warranties (or guarantees) are made or relied upon as to: (a) the design, construction, completion, development, use, benefits, or value of the Properties; or (b) the number, types, sizes, prices or designs of any structures to be built in any part of the Properties. We have obtained 119 signed petitions and online surveys indicating approval for the project. The equipment was purchased almost a year ago and has been in storage since. The tot lot is in an area designated as open space and is used as a play field for many children. There are no other viable locations for this tot lot. The area discussed by some in Camden Gardens is too remote and there are few homes in this area. This presents a security/safety issue for the children. The residents are overwhelmingly in favor of this project in this location. Therefore we come before this Board to request approval of such. Camden Gardens
