12. www.transporta6 ion.ohio.gov 12 February 26, 2013 APPRAISAL Definition of Fair Market Value as per Ohio Jury Instruction  Fair Market Value is the amount of money which could be obtained on the market at a voluntary sale of the property. It is the amount that a purchaser who is willing, but is not required to buy, would pay and that a seller who is willing, but not required to sell, would accept, when both are fully aware and informed of all the circumstances involving the value and use of the property.

17. www.transporta6 ion.ohio.gov 17 February 26, 2013 EMINENT DOMAIN  If an agreement cannot be reached  An action will be filed in the Court of Common Pleas  ODOT deposits with the Clerk of Courts at least the amount of the appraisal  Once deposited those funds can be withdrawn  Negotiations may continue at all times  Jury of peers will decide the amount of the award
