1 COURTS, JUDGES AND THE LAW Key Terms on Judicial Branch

2 CRIMINAL LAW  The branch of law that regulates individual behavior, lists crimes, and determines punishments for breaking the law. In criminal trials, the government is the prosecutor, since criminal acts are considered crimes against society.

3 CIVIL LAW  The branch of law that concerns relationships between private parties (individuals, organizations, businesses, government institutions, etc.). A civil action is known as a lawsuit, and is usually filed by someone who claims to have suffered a loss because of another party’s actions.

4 BURDEN OF PROOF  The obligation in a legal case to prove allegations by presenting strong supporting evidence. In a criminal case, this burden is with the prosecution to prove the guilt of the defendant, beyond a reasonable doubt. Those charged with crimes are considered innocent until proven guilty.

5 DEFENDANT  In a criminal trial, this is the person or group who is charged with committing a crime.  In a civil trial, this is the person or group being sued.

6 PROSECUTION  The attorneys representing the government and the people in a criminal case (known as attorney general at state and federal level). The prosecution must show the judge and jury beyond a reasonable doubt that the defendant should be found guilty as charged.

7 PLAINTIFF  The person or group who brings a lawsuit or legal action against another party in a civil case.

8 WRIT OF CERTIORARI  An order from the Supreme Court to a lower court to provide the records of a case the Court has decided to review.

9 LEGAL BRIEF  A written document created by a lawyer that presents the facts and points of law in a client’s case.
