Eighth Amendment A. Purpose of bail is to insure that a person will return for trial 1. Courts can demand the full bail, but in most states the person accused of the crime has to pay 10% - s/he gets the money back when they return to court 2. Court keeps the money if you don’t return 3. Can go to a bond company 4. “Excessive bond shall not be required” but often a poor person could remain in jail for entire period before trial and then be found not guilty

Eighth Amendment B. A person can be released on their own personal recognizance (if a person is likely to return for trial, a judge can make the decision to waive bail)

Eighth Amendment C. Government cannot impose any punishment that is cruel or unusual; punishment must be appropriate for the crime

Ninth Amendment The enumeration of the Constitution of certain rights shall not be construed to deny or disparage others retained by the people
5
Tenth Amendment The powers not delegated to the United States by the Constitution, nor prohibited to it by the states, are reserved to the states respectively, or to the people.
