1. Eighth Amendment A. Purpose of bail is to insure that a person will return for trial 1. Courts can demand the full bail, but in most states the person accused of the crime has to pay 10% - s/he gets the money back when they return to court 2. Court keeps the money if you don’t return 3. Can go to a bond company 4. “Excessive bond shall not be required” but often a poor person could remain in jail for entire period before trial and then be found not guilty

2. Eighth Amendment B. A person can be released on their own personal recognizance (if a person is likely to return for trial, a judge can make the decision to waive bail)

3. Eighth Amendment C. Government cannot impose any punishment that is cruel or unusual; punishment must be appropriate for the crime

4. Ninth Amendment The enumeration of the Constitution of certain rights shall not be construed to deny or disparage others retained by the people

5. Tenth Amendment The powers not delegated to the United States by the Constitution, nor prohibited to it by the states, are reserved to the states respectively, or to the people.
