Draft High level Business Rules ‘Back stop’ terms requiring DNO to assume role of ‘last resort’ resolver of USRV New definition required when USRV status changes (becomes [x]SRV) Does not preclude User from entering into any ‘non-code’ arrangements with xoserve or any other agent to facilitate resolution of USRV

Draft High level Business Rules Optimal period before status change User must have opportunity and incentive to resolve Code Mods 0637 & 0141 Between 18 months – 2 years optimal Primary obligation to resolve USRV is with the User (who was registered when ‘filter failure’ occurred). Evidence that clearance rates continues up to 2 years then slows significantly

Draft High level Business Rules Upon status change USRV User to provide relevant data (where possible) upon request from DNO Upon status change User may still resolve (up to point that DNO approves [x]SRV) but charge still applies ‘Reasonable endeavours’ provision for DNO to resolve [x]SRV. At DNO’s discretion, where not practicable to resolve, deemed allocation applied and [x]SRV lapses.

Draft High level Business Rules Where site visit necessary, relevant User to facilitate access to property DNO decision on resolution and subsequent billable volumes not subject to query in respect of the volume pursuant to TPD S4 by any User. DNO decision binding Service chargeable irrespective of whether [x]SRV resolved or deemed allocation applied Resolution of [x]SRV may result in new USRV. DNO will approve automatically.
