2 Consent Exceptions 10/10/12 Objective: SWBAT explain the meaning of capacity to consent and the criteria of capacity to consent Initial Activity: TO BE COLLECTED (20 min to write)  Summarize the gist of the movie (5 sentences)  What challenges did Anna face in her quest to be medically emancipated?  What challenges did her sister Kate face in acting out her medical wishes?  What would you have done in this situation if you were their mother Sara?

3 Incapacity Defined as lacking the freedom to make authentic decisions even when given the opportunity.

4 Criteria to be Able to Consent The ability to understand given information The ability to appreciate the nature of the situation The ability to asses the relevant facts The ability to exercise choice The ability to use understood information for realistic and reasonable situations The ability to appreciate the consequences of giving or refusing consent

5 Brainstorm and Discussion Why is it important to make special arrangements for persons without the capacity to consent? What would these arrangements sound like? look like? Use scenarios like the person being a minor, mentally ill or unconscious as a spring board.

6 Homework Identify 5-6 sources (print, internet, movie etc.) that you can use for your research paper due on October 19 th. 8 Our Project End Goal: To conduct a complete moral deliberation about your research topic Immediate Goal: Identifying the relevant facts of the case and honing in on the “problem”

9 What is a thesis? A thesis statement is a strong statement that you can prove with evidence. It is not a simple statement of fact. A thesis statement should be the product of your own critical thinking after you have done some research. Your thesis statement will be the main idea of your entire project. It can also be thought of as the angle or point of view from which you present your material.

10 Statement of Purpose A Statement of Purpose is a sentence that you write, which states, in some detail, what you want to learn about in your research project. The statement guides you as you work so that you will read and take notes only on what's needed for your project.

11 Writing a Statement of Purpose Ask yourself… 1. What is my real personal interest in the topic? (There will always be something that can interest you) 2. What do I specifically want to learn about my topic? (Don't overwhelm yourself with too many things. Two or three are plenty.) Start your Statement of Purpose with words like "I want to learn about..."

12 For example…. For example: One person was very concerned about air pollution and wanted to know if the government is doing anything to stop it. Her Statement of Purpose was this: I want to learn about what is being done by our government to stop air pollution. This Statement of Purpose will lead her to eventually write a Thesis Statement in which she will be able to make an assertion (a statement she can defend) and support it with the evidence she has gathered in her research. Her Thesis Statement may sound something like this: "In the United States, government regulation plays an important role in the fight against air pollution." Or, conversely, "United States government regulation has little effect in the fight against air pollution." Whichever the case, she will use the evidence she has gathered in her research to prove her Thesis Statement.

15 Identifying Research Questions We do this so we don’t get off track! Helps us formulate a thesis Types ▫Factual and Interpretive ▫Complete the “Research Questions” section of the packet

16 Writing Your Thesis Look again at your Statement of Purpose Look at the kinds of information you have been finding while taking notes or researching Decide what kind of statement you have enough evidence to prove. (Be sure that you have done enough research to make a strong argument. You may be challenged.) Write that as your thesis statement.

17 Your thesis will be two parts Our end thesis will argue for a particular course of action. Our current thesis should be a statement about the situation Ex: In case of Mann vs. Ford, Ford Motor Company exhibited gross negligence against the Native Indians. This is evidenced by the presence of toxic waste.

19 Moving forward….. Use your research questions to guide your research of the case Remember, you will eventually be arguing for a course of action so make sure you have enough evidence to back up your stance Begin writing “The Case” section of the paper (4- 5 pages) ▫Use proper citation format (MLA)
