3.  Representing defendants ◦ Due diligence—entitled to due process  Prosecuting criminal defendants ◦ Duty is to see that justice served—not to get a conviction  Exchange of evidence ◦ Prosecutor must divulge exculpatory evidence ◦ Defense must exchange if no 5 th Amend. Right involved.

4.  Supression of evidence ◦ Trial ◦ Discovery  Fabricating evidence ◦ Inducing client to testify falsely ◦ Tampering with evidence ◦ Allowing a witness to lie ◦ Allowing a client to lie  Deceit Court Opposing Counsel

5.  Jurors ◦ No contact during trial ◦ Okay to talk to jurors after if willing  Treatment of Court/judges ◦ No contact without other side present ◦ No gifts ◦ Truthful at all times  Meritless cases
