Vision: Working together to rid society of corruption 7 Mission: We are a state body that fights corruption through quality forensic investigations and litigation Social Grant Proclamation Investigation initiated by the Minister and Department of Social Development ( DSD ) Proclamation published on 6 April 2005 to investigate Corrupt DSD officials Beneficiaries unlawfully receiving benefits 3 year cooperation agreement R22 million for 2005/06 for 80 staff R 43 million for 2006/07 for 160 staff by Dec 2006 R58 million for 2007/08 for 200 staff by Jul 2007 Currently 85 full-time and 21 part-time staff

Vision: Working together to rid society of corruption 20 Mission: We are a state body that fights corruption through quality forensic investigations and litigation 4) Prosecutions 13 920 possible prosecutions of public servants 1 520 prosecutions to Jul 06 846 finalised, 770 convictions Charged with fraud or receiving benefit to which not entitled, resulting from Misrepresentation about income or employment status Failure to disclose change in financial circumstances Sentences - apply guidelines, vary from: Imprisonment of up to 3 years Fines: R500 - R70 000 + suspended imprisonment Fully suspended sentences

Vision: Working together to rid society of corruption 21 Mission: We are a state body that fights corruption through quality forensic investigations and litigation 5) Disciplinary processes 21 588 irregular beneficiaries will be referred to their host departments Individual departments have already taken some action DPSA is coordinating process and preparing guidelines Disciplinary process piloted in KZN Aim to prepare 7 000 disciplinary files for departments this year

Vision: Working together to rid society of corruption 22 Mission: We are a state body that fights corruption through quality forensic investigations and litigation 6) Recovery of debt Slow and cumbersome process to compel debtors to pay Have to obtain a civil judgment in magistrate’s court Execution order if do not pay Cannot order person to pay more than they can afford Require evidence to refute version of debtor SIU tries to expedite process by recovering from those who are willing to start repaying Formalise agreement through Acknowledgement of Debt Made a condition of sentence in some cases

Vision: Working together to rid society of corruption 23 Mission: We are a state body that fights corruption through quality forensic investigations and litigation Acknowledgement of Debt Formalise agreement through Acknowledgement of Debt ( AOD) Expedites litigation process AOD is for amount willing and able to pay Negotiate but cannot compel to go beyond what they are willing to pay or can afford It is not a settlement, ie no debt or interest is written off Only Accounting Officer can write off debt eg if not economical to collect Does not preclude DSD or SIU to take matter to court

Vision: Working together to rid society of corruption 25 Mission: We are a state body that fights corruption through quality forensic investigations and litigation Repayment periods Average repayment = 33 months 65.8% 3 years or less 92.5% 5 years or less 97.5% 8 years or less 2.5% More than 8 years From an SIU review, it is clear that in few cases, people earning substantial salaries are paying small amounts over excessive periods Will attempt to re-negotiate – else take legal action
