LEGISLATION NCAA Bylaw 13.02.17 – IAWP – Men’s Basketball An IAWP is: Any person who maintains (or directs others to maintain) contact with a prospect, the prospect’s relatives or legal guardians or coaches during the prospect’s participation in basketball; and Whose contact is directly or indirectly related to his athletics skills and abilities or his recruitment or enrollment. Definition includes (but is not limited to): Parents, legal guardians; Handlers, personal trainers; and Coaches. Status retained throughout enrollment.

LEGISLATION Bylaws 11.4.2 and 13.8.3.2 – IAWP – Men’s Basketball For a two-year period before and a two-year period after a prospect’s anticipated enrollment, an institution shall not employ an IAWP as noncoaching or strength and conditioning staff member. A violation occurs: At the time of employment if an associated prospect enrolled in the previous two years; or At the time an associated prospect enrolls if the IAWP is already employed. Student-athlete (SA) is ineligible if violation occurs.

NEW LEGISLATION NCAA Division I Proposal No. 2015-30. An institution may reassign an individual associated with a prospective student-athlete (PSA) from a countable coaching staff position to a noncoaching staff position or strength and conditioning staff position, provided the individual has been a countable coach at the institution for at least the previous two academic years. Bylaws 11.4.2.2 and 13.8.3.2.2 Exception -- Reassignment

LEGISLATION Bylaw 13.2.1.2 – Consulting Fees – Men’s Basketball No consulting fee may be provided to an IAWP or a firm in which an IAWP has a proprietary or financial interest.

LEGISLATION Bylaw 13.8.3.1 – Employment in Athletically Related Activities – Basketball No employment (either on a salaried or a volunteer basis) of an individual as a speaker or presenter at any athletically related institutional event or activity (e.g., booster club function, outside consultant) if that individual: Is involved in coaching PSAs; or Is associated with a prospect as a result of the prospect’s participation in basketball.

LEGISLATION Bylaw 13.12.2.2.2 – Camp or Clinic Speaker – Basketball No employment (either on a salaried or a volunteer basis) of speaker at an institution’s camp or clinic (including a coaches clinic or camp or clinic involving nonprospects) who is involved in coaching PSAs or is associated with a PSA as a result of the PSA’s participation in basketball.

LEGISLATION Bylaw 13.12.2.2.3 – IAWRP – Men’s Basketball No employment (either on a salaried or a volunteer basis) of an individual associated with a recruited prospect (IAWRP) at an institution’s camp or clinic.

LEGISLATION Bylaw 13.15.1.10 – Donation to Nonprofit Foundation – Men’s Basketball No donation to a nonprofit foundation that expends funds for the benefit of a: Nonscholastic team or teams; Prospects; or IAWP. Regardless of whether the foundation provides funding to, or services to, prospects and individuals who are not prospects.

Strength and Conditioning Coach. Your athletics academic services director is hiring and she wants to fill the following positions: Football Tutor. Class Attendance Monitor. Women’s Basketball Academic Advisor.

ANALYSIS - RELATIONSHIP What is the relationship between the athlete and the individual? Bylaw 13.02.17 Men’s basketball wants to hire a video coordinator. The candidate’s father is a local nonscholastic coach and an IAWP for a committed prospect who will enroll this fall. ANALYSIS – TIME FRAME What is the time frame for student-athlete eligibility ramifications? Bylaw 11.4.2.1 Men’s basketball wants to hire a special assistant and his son has verbally committed. ANALYSIS – HIRING IAWP Case Study Your men’s basketball head coach wants to hire Ben Davis as a director of operations. Davis spent the 2013-14, 2014-15 and 2015-16 seasons as assistant coach at State University (SU). Johnny Hopkins, a current junior men’s basketball SA, transferred to your institution from SU and enrolled August 1, 2015. Davis recruited and coached Hopkins at SU. Davis’ hire date will be August 1, 2016.

INSTITUTIONAL CAMPS Who can we employ at institutional camps? Bylaws 13.12.2.2.2, 13.12.2.2.3 & 13.12.1.1.1.1 Men’s basketball wants to employ a local high school boys’ basketball coach as summer camp director. Men’s basketball is not recruiting any of the high school coach’s players. The high school coach is an IAWP for a junior SA on your institution’s team. Women’s basketball wants to employ a local high school boys’ basketball coach as a summer camp instructor. Men’s basketball is currently recruiting a player from the high school coach’s team.

DONATION TO NONPROFIT Who benefits from the donation? Bylaw 13.15.1.10 May not provide a donation to a nonprofit foundation that expends funds for a nonscholastic team, PSAs or IAWPs. The State Basketball All-Star Classic is hosting a golf outing fundraiser. Your institution has been asked to donate a signed basketball for the fundraiser’s silent auction. Proceeds from the silent auction will be donated to The V Foundation for Cancer Research. Institution’s Donation Nonprofit that benefits PSAs Nonprofit with Non-Athletics Purpose
