3 ConfidentialBhupen Dubey SEED TRADE: IMPORTATION The objective of the import policy is to provide the best planting material available anywhere in the world to Indian farmers, to increase productivity, farm income and export earnings, while ensuring that there is no deleterious effect on environment, health and bio-safety. All import of seeds and planting materials, etc. will be allowed freely subject to EXIM Policy guidelines and the requirements of the Plants, Fruits and Seeds (Regulation of import into India) Order, 1989 as amended from time to time. Import of parental lines of newly developed varieties will also be encouraged. Seeds and planting materials imported for sale into the country will have to meet minimum seed standards of seed health, germination, genetic and physical purity as prescribed. EXIM committee approval is required for importation of seeds other than vegetable seeds. 3

4 ConfidentialBhupen Dubey All imports of seeds will require a permit granted by the Plant Protection Advisor to the Government of India, which will be issued within the minimum possible time frame. All seeds imported into the country will be required to be accompanied by a certificate from the Competent Authority of the exporting country regarding their transgenic character or otherwise. Seeds of transgenic plant varieties for research purposes will be imported only through the National Bureau of Plant Genetic Resources (NBPGR) as per the EPA, 1986. If the seed or planting material is a product of transgenic manipulation, it will be allowed to be imported only with the approval of the Genetic Engineering Approval Committee (GEAC), set up under the EPA, 1986. All importers will make available a small sample of the imported seed to the Gene Bank maintained by NBPGR. 4

6 ConfidentialBhupen Dubey Seed Trade: Export Government of India will evolve a long term policy for export of seeds with a view to raise India's share of global seed export from the present level of less than 1% to 10% by the year 2020. The export policy will specifically encourage custom production of seeds for export and will be based on long term perspective, dispensing with case to case consideration of proposals. Restrictions on cultivated varieties of seeds removed. Restrictions on export: (i) Breeder or foundation or wild varieties. (ii) Onion, Berseem, cashew, nux vomica, rubber, pepper cuttings, sandalwood, saffron, neem, forestry species and wild ornamental plants. (iii) export of Niger which is canalized through TRIFED, NAFED, etc. (iv) groundnuts, exports of which is subject to compulsory registration of contract with APEDA. 6

8 ConfidentialBhupen Dubey SEED TRADE: QUARANTINE While importing seeds and planting material, care will be taken to ensure that there is absolutely no compromise on the requirements under prevailing plant quarantine procedures, so as to prevent entry into the country of exotic pests, diseases and weeds detrimental to Indian agriculture. Inspection of agricultural commodities meant for export as per the requirements of importing countries under International Plant Protection Convention (IPPC) 1951 of FAO as per the model certificates prescribed under IPPC and issue Phytosanitary Certificate 8

10 ConfidentialBhupen Dubey Issue of Import Permit: An importer intending to import agricultural commodities has to apply in advance for the issue of import permit in respect of the commodities listed in schedule V and VI of PQ order, 2003 in the prescribed form. 10

11 ConfidentialBhupen Dubey Export Inspections: The export inspections are carried out to facilitate certification of exportable plants and plant material as per the requirement of importing country. The export inspections involves sampling and detailed laboratory tests in case of seeds and planting material for propagation 11

12 ConfidentialBhupen Dubey Import Permit: A document issued by a national government authorizing the importation of certain goods into its territory. 12

13 ConfidentialBhupen Dubey Bill of Entry A declaration by an importer or exporter of the exact nature, precise quantity and value of goods that have landed or are being shipped out. Prepared by a qualified customs clerk or broker, it is examined by customs authorities for its accuracy and conformity with the tariff and regulations. 13

14 ConfidentialBhupen Dubey Bill Of Lading It is an official receipt given by the shipping company as an acknowledgement of the receipt of goods to be transported to the port of destination. It is also a contract for the carriage of goods. 14

15 ConfidentialBhupen Dubey Certificate of Origin It is an important international trade document attesting that goods in a particular export shipment are wholly obtained, produced, manufactured or processed in a particular country. 15

16 ConfidentialBhupen Dubey Commercial Invoice Document required by customs to determine true value of the imported goods, for assessment of duties and taxes 16

17 ConfidentialBhupen Dubey Marine insurance It covers the loss or damage of ships, cargo, terminals, and any transport or cargo by which property is transferred, acquired, or held between the points of origin and final destination. 17

18 ConfidentialBhupen Dubey Letter of Credit It is a letter from a bank guaranteeing that a buyer's payment to a seller will be received on time and for the correct amount. In the event that the buyer is unable to make payment on the purchase, the bank will be required to cover the full or remaining amount of the purchase 18

19 ConfidentialBhupen Dubey Phytosanitary certificate Phytosanitary certificates are issued to indicate that consignments of plants, plant products or other regulated articles meet specified phytosanitary import requirements and are in conformity with the certifying statement of the appropriate model certificate 19
