3 EXPENSES FOR OTHER COMPETITION – NCAA BYLAW 16.8.1.2

4 Bylaw 16.8.1.2 – Other Competition Current Application of the Rule May provide actual and necessary expenses for: – Established national championship events. – Qualifying competition for the Olympics and other international events. – National team tryout events.

5 Bylaw 16.8.1.2 – Other Competition (cont.) Current Application of the Rule (cont.) SA must be eligible for competition that year. Event can occur in the ensuing summer.

6 Bylaw 16.8.1.2 – Other Competition (cont.) Analysis Determine if the event is a permissible event. – How is this determined? By whom? – “Tiered” qualifiers. – Individual vs. team sports.

10 Awards vs. Prize Money Current Application of the Rule Prize money. – Permissible based on place finish or performance. – May not exceed actual and necessary expenses. – Must come from the sponsor of the event.

11 Awards vs. Prize Money (cont.) Current Application of the Rule (cont.) Awards. – Are received for participation in competition. – Can be for intercollegiate or outside competition. – May not include cash (or cash equivalents) that exceeds actual and necessary expenses.

21 Interpretations Philosophy Case 1 Question Is it permissible for an institution to provide a file (hard or electronic copy) of game film to a SA or a family member of the SA? – Additional facts: Not provided for film review purposes. Intended to be a keepsake or memento. Raw footage; not a highlight video.

Answer Interpretations philosophy is applicable. – The provision of game film is a permissible benefit incidental to participation. – Under the facts provided, it is permissible to provide game film to an SA's family member. – Nominal value of memento to family member.

23 Interpretations Philosophy Case 2 Question Can a current SA have institutional staff members, including athletics staff, watch her child while she is traveling for competition? – Additional facts. International SA. Offer of assistance is limited to travel for competition.

Answer Interpretations philosophy is applicable. – Institutional staff, including athletics staff, can watch SA's child without triggering the extra-benefit legislation. – The benefit is incidental to participation. – The benefit is occasional in nature; and – The benefit involves SA's well-being.

Since then, GP has sent SA No. 1 the following: – One additional care package with food items of nominal value; – A used suit jacket; and – A set of full-size bed sheets purchased for $19.99.

28 Interpretations Philosophy Case 3 (cont.) Answer The food provided can be considered an occasional meal under Bylaw 16.11.1.7. The interpretations philosophy is applicable to permit the other items identified in the request.
