Eliminate VMC 20.883, Medical Marijuana Collective Gardens. These no longer authorized by state law as of 7/1/16, and no local applicants or inquiries received since 20.883 was adopted in 2012. Add VMC 20.884 language affirming rights of individual medically authorized users to grow or designate a grower pursuant to state law Add VMC 20.884 language allowing licensed research facilities in IL and IH zones, subject to the 1000 foot buffer Proposed Changes Marijuana amendments - 4

Add VMC 20.884 language affirming new state requirement that medical marijuana growing or possession not be smelled or seen from public areas or adjacent private residences. Eliminate VMC 20.884.030.C prohibition of off-premise signs for marijuana facilities. This prohibition is unique to marijuana in city code, and is problematic in regards to recent caselaw on signage regulations. Proposed Changes (cont.) Marijuana amendments - 5
