What is Reciprocity?

5 Miami to Seattle Florida Call #1: Need trip permit or can register your 20,000 lb truck as apportionable … call permit office for more information. Call #2 (permit office): Don’t need to register in any state for vehicle less than 26,000 lbs. Georgia Call # 1: “Contact your local county office, we don’t register trucks under 26,000 lbs.” Call # 2: Can operate under 26,000 lbs without registration for inter. For intra must purchase temporary permit from private firm. Tennessee Can operate 26,000 lbs for inter. If truck is “for hire” will be required to register “federally.” If going into Kentucky “KYU” is required. Kentucky “Don’t need anything for inter.” Need to register (plates and license) in tucky for intra. Illinois Can operate under 26,000 for inter. Must register as apportionable for intra. Missouri No restrictions for intra and inter. Need to stop at weigh scales if over 18,000 lbs. Regulations same as IFTA. Iowa (Transferred to Port of Entry) Inter is permitted under 26,000 lbs. Intra application required through Port of entry. South Dakota Can operate under 26,000 lbs without registration for inter. Need temporary permit or South Dakota registration for intra. Wyoming Transferred to Cheyenne Port of Entry. Under 26,000 lbs probably not required to register but must stop at weigh stations. Idaho Allows a CV under 26,000 lbs free operation without registration. Regulation is in policy (possibly related to IRP) but is not clearly defined. Washington State Free to operate for intra and inter under 26,000 lbs regardless of base jurisdiction.

6 Findings-“ It’s not that easy.” Key Challenges –Some exemptions are in policy, but not easily accessible for staff or customers: “I believe it is in the weigh scale procedure manual (which hardly anyone ever looks at).” –Exemptions for 26,000 lbs were not related to reciprocity agreements. –Several agreements in place but many are dated, not understood or not followed. –No state was able to provide documentation of specific rules for an under 26,000 lb truck.

7 St. Johns to Victoria CV with a GVW of less than 11,794 kg can perform inter- jurisdictional operations without registration. Temporary permit can be purchased from province for intra-jurisdictional operations. Exemption in CAVR (Category B vehicles).

8 What is CAVR? The Canadian Agreement on Vehicle Registration A free reciprocity agreement between all Canadian provinces for commercial vehicles not covered by IRP. –Don’t need to obtain a vehicle license or pay fees to the host jurisdiction. –Plate issued in base jurisdiction is recognized across Canada. CAVR revised in 2001 to provide for limited licensing reciprocity for non-apportioned commercial vehicles. Allows provinces to have exceptions (as of 2012 BC remains the only province with any exceptions).

AAMVA Registration Reciprocity Agreement Developed by AAMVA in 1988. 6 Signatories (Indiana, Maryland, Michigan, Pennsylvania, Wisconsin, Maine). Provides for –Passenger cars/ non-commercial vehicles –Students –Military personnel’s vehicles –Commercial Vehicles, charter buses, restricted plated (limited to inter) 9

10 Reciprocity in the 21 st Century? Very difficult to compile reciprocity agreements in research for presentation. Many current agreements are nearly 50 years old! 14 INCVA Key Principles Supersedes all other reciprocity agreements for commercial vehicles (with the exception of the IRP Agreement) Companion agreement to the IRP Applies only to non apportionable vehicles under IRP and vehicles where apportioning is optional under IRP Voluntary and willing participation by all states and provinces Flexible!

Inter Reciprocity Full and Free Registration Reciprocity for Interjurisdictional Movement: –can be exclusions for some types of vehicles (e.g., charter buses, differing jurisdictional definitions of commercial vehicle) –trailer reciprocity is unconditional license plate accepted without additional requirements or registration fees in host jurisdiction. 19

Intra Reciprocity Temporary intra Full and Free Registration Reciprocity: -Jurisdiction can opt out -Agreement will provide clarity and certainty for what intra is/isn’t allowed -Jurisdiction can define “temporary”: -INCVA default time limit 30 days a year -Any limit to intra outlined in appendix 20

23 Pros of INCVA Would not require significant changes from current practices (at least for inter) Reduced administrative burden and costs Consistency Predictable CVSA likes it Accessible for jurisdictions, industry and enforcement Aligns with IRP goals Reduces inter-jurisdictional trade barriers.

24 Cons of INCVA Appendix has the potential to be cumbersome. Don’t ask a question you don’t want to hear the answer to. Requires jurisdiction to do their homework to be clear and know exactly what level of reciprocity they provide.

Some Industry Thoughts… Increase certainty for registering non- apportioned commercial vehicles “Carriers don't mind complying with permit requirements; however, when the actual requirements are not clear, it is frustrating and costly.” Increased efficiency of commerce Service bureaus & truck lessors like it

Summary - Key Messages –Many opportunities to improve practices for non- apportioned commercial vehicles operating in Canada and the US. –For most jurisdictions, INCVA will not differ from current practices. –INCVA provides an opportunity to make information on reciprocity accessible and consistent. –INCVA is flexible – jurisdictions with varying levels of reciprocity can join. 26
