Landmark case Plaintiff Defendant Adversarial Process Judicial Review A type of court case that is very important because of issues involved. Ruling has an effect on entire United States. The Constitutional issues dealt with in this type of case change the way the Constitution is interpreted.

4 What is a landmark? A distinguishing event or object. Stands out among others. Due to its importance or size.

5 Landmark Court cases Stand out due to important issues. What issues? 1. Right was challenged 2. Law was challenged 3. Prior court’s ruling was challenged

6 Court cases and their sides Cases are “fights” between two sides Plaintiff- side bringing or pressing charges or accusing. [1] The government’s District Attorney can try to find accused criminal guilty of crimes. [2] People suing can try to find people responsible for damage to property. Defendant- side disputing or defending against charges or accusation. [1] People accused of a crime by a District Attorney can deny the charges and prove their innocence. [2] People being sued can try to disprove the accusations against them. Often called an adversarial process because of competition between two different “sides.” Having opposing sides can help to insure justice is served

7 Landmark case #1 [Marbury v Madison] Outgoing President John Adams approved several jobs to people. Incoming President Jefferson disapproved of those people. Jefferson ordered his assistant James Madison not to deliver on the jobs

8 Landmark case #1 [Marbury v Madison] One person who was promised a job sued Madison. William Marbury wanted his job and sued Madison. Court ruled that Marbury’s rights were violated. Court could not grant him the commission because the law [Judiciary Act of 1789] giving authority to do so was unconstitutional. The case proved that the Supreme Court had the right to say what the constitution means What is this power called? Judicial Review What does that mean? The Supreme Court has the right to declare laws passed by Congress or actions of the president unconstitutional
