3 DRAFT REGULATIONS ON END-OF-LIFE VEHICLES Public Consultation Definitions ‘End-of-life vehicle’: a vehicle which is waste. ‘Waste’: any thing, substance, product or object, whether in solid or liquid form, whether hazardous or otherwise, which the holder discards, or intends, or is required to discard.

4 DRAFT REGULATIONS ON END-OF-LIFE VEHICLES Public Consultation ‘Permit’: any permit issued by MEPA under regulation 9 to the Waste Management (Permit and Control) Regulations, 2001, as published by Legal Notice 337 of 2001. Definitions

5 DRAFT REGULATIONS ON END-OF-LIFE VEHICLES Public Consultation ‘Waste Management’ means any activity whereby waste is handled including: Definitions a. Storage b. Collection c. Sorting d. Transport e. Treatment f. Recycling

A rrangement for brokerage and supervision of such operations on behalf of a third party j. Ownership, management and after- care of sites used for the storage, treatment, recovery, deposit or disposal of waste

7 DRAFT REGULATIONS ON END-OF-LIFE VEHICLES Public Consultation Article 9 to LN 337 of 2001 Any person proposing to: Set up and operate an undertaking which is listed in Schedule 7 to LN 337 of 2001; or Undertake a waste management activity must apply to MEPA for a waste management permit (WMP).

8 DRAFT REGULATIONS ON END-OF-LIFE VEHICLES Public Consultation The following undertakings involved in the life cycle of vehicles require a WMP: Those producing and processing metals in quantities and/or qualities as specified in Schedule 7 to LN 337 of 2001; Those storing, collecting, sorting and transporting end-of life vehicles, including their components and materials; WMP and End-of Life Vehicles

9 DRAFT REGULATIONS ON END-OF-LIFE VEHICLES Public Consultation WMP and End-of Life Vehicles Those directly involved in treatment activities of end-of life vehicles, including their components and materials, such as: a. Depollution b. Dismantling c. Shearing d. Shredding e. Recovery/Recycling f. Disposal of the wastes

10 DRAFT REGULATIONS ON END-OF-LIFE VEHICLES Public Consultation WMP and End-of Life Vehicles Those who arrange for brokerage and/or supervision of such operations on behalf of a third party; Those who own, manage and supervise the after-care of sites used for such operations (e.g. scrapyards).

11 DRAFT REGULATIONS ON END-OF-LIFE VEHICLES Public Consultation Minimum technical requirements Impermeable surfaces for appropriate areas with the provision of spillage collection facilities, decanters and cleanser-degreasers; Equipment for the treatment of water, including rainwater, in compliance with health and environmental regulations; Sites for Storage prior to Treatment

12 DRAFT REGULATIONS ON END-OF-LIFE VEHICLES Public Consultation Minimum technical requirements Storage operations are to be carried out avoiding damage to components containing fluids or to recoverable components and spare parts.

13 DRAFT REGULATIONS ON END-OF-LIFE VEHICLES Public Consultation Minimum technical requirements Impermeable surfaces for appropriate areas with the provision of spillage collection facilities, decanters and cleanser-degreasers; Appropriate storage for dismantled spare parts, including impermeable storage for oil- contaminated spare parts; Sites for Treatment

14 DRAFT REGULATIONS ON END-OF-LIFE VEHICLES Public Consultation Minimum technical requirements Appropriate containers for storage of batteries (with electrolyte neutralisation on site or elsewhere), filters and PCB/PCT-containing condensers; Equipment for the treatment of water, including rainwater, in compliance with health and environmental regulations; Appropriate storage for used tyres, including the prevention of fire hazards and excessive stockpiling.

15 DRAFT REGULATIONS ON END-OF-LIFE VEHICLES Public Consultation Minimum technical requirements Appropriate storage tanks for the segregated storage of end-of-life vehicle fluids such as: a. Fuel; b. Motor oil, gearbox oil, transmission oil, hydraulic oil; c. Cooling liquids, antifreeze, brake fluids; d. Battery acids, air-conditioning system fluids; e. Any other fluid contained in the end-of-life vehicle.

16 DRAFT REGULATIONS ON END-OF-LIFE VEHICLES Public Consultation Minimum technical requirements Removal of batteries and liquefied gas tanks; Removal or neutralisation of potential explosive components, (e.g. air bags); Removal, as far as feasible, of all components identified as containing mercury; Treatment Operations for Depollution

17 DRAFT REGULATIONS ON END-OF-LIFE VEHICLES Public Consultation Minimum technical requirements Removal and separate collection and storage of the following unless they are necessary for the re-use of the parts concerned: a. Fuel; b. Motor oil, transmission oil, gearbox oil, hydraulic oil; c. Cooling liquids, antifreeze, brake fluids; d. Battery acids, air-conditioning system fluids; e. Any other fluid contained in the end-of-life vehicle.

18 DRAFT REGULATIONS ON END-OF-LIFE VEHICLES Public Consultation Minimum technical requirements Removal or catalysts; Removal of metal components containing copper, aluminium and magnesium if these metals are not segregated in the shredding process; Removal of glass; Treatment Operations for Recycling

19 DRAFT REGULATIONS ON END-OF-LIFE VEHICLES Public Consultation Minimum technical requirements Removal of tyres and large plastic components (bumpers, dashboard, fluid containers, etc.), if these materials are not segregated in the shredding process in such a way that they can be effectively recycled as materials.

20 DRAFT REGULATIONS ON END-OF-LIFE VEHICLES Public Consultation Conclusions Waste management activities involved in the life cycle of vehicles are numerous; Such activities shall be carried out in accordance with the provisions of LN 337 of 2001 and in compliance with the minimum technical requirements; Any establishment or undertaking carrying out such activities shall apply with and hold a valid waste management permit from MEPA.
