September 27, 1988 Joint Use Agreement. October 15, 1990 Agreement for the joint construction and use of Joaquin Miller Elementary School. September 2001 Amendment to Joint Use Agreement extending term of prior Agreements to September 27, 2011. April 2007 Memorandum of Understanding- funding of both high school projects and Jordan Middle School project.

BUSD staff currently reviewing draft document. City staff to incorporate funding direction into draft document. City/BUSD staff to review contract documents for Burbank High School. City Council to consider joint use agreement and Burbank High contract documents/plans/specs in approximately two weeks. BUSD to consider joint use agreement.

Capital Financing & Construction: City to invest and hold funds (including District’s share) in an account. Release of funds to contractor. Plans/Specs/Contract documents. City insurance and indemnity. Change Orders.

Capital Financing & Construction (cont): Construction Manager to be used. BUSD will award bids and manage projects. City to participate in construction meetings.

Shared Use of Three New Facilities: Guaranteed time schedules will be exhibits to the Agreement. District to maintain, but City to share in the costs of maintaining the restrooms.

Shared Use of Three New Facilities (cont): Replacement Track and Field Fund will be District’s obligation: The purpose is to replace the tracks when needed and the fields when needed. BUSD $500,000 initial payment and $100,000 annual payments. Interest to be applied to the fund. BUSD will maintain control of these funds, and provide an annual statement of the funds.

Joint Use of Other Facilities: Restates existing agreement, but changes the annual cost to the City to reflect the amount agreed to by City Council and BUSD Board at January 31, 2007 joint meeting. City’s capital annual costs of $100,000 to BUSD for facilities impacted by City’s use. Continues use of permits, annual master calendar.

Joint Indemnification Provision and Insurance. Audit rights. Nondiscrimination. Report of Dangerous Condition. Inspection of shared premises before use.
