RATIONALE FOR DEVELOPING SIMPLIFIED GUIDE Major challenges facing women in business (particularly those in cross border trade) include: Inadequate awareness and access to information on trade and market intelligence. Inability to interpret trade rules/procedures and regulations. As a result women in business are unable to effectively access national and regional markets. This Guide has been prepared to address the above challenges.

5. OBJECTIVES OF THE SIMPLIFIED GUIDE The Guide provides pertinent information on key rules and procedures for trading within the EAC (intra-EAC trade), in a simplified and user-friendly manner. The rules and procedures are presented in the three key sections; 1. Rules relating to trade in agricultural produce; 2. Rules relating to trade in semi-processed and manufactured goods and 3. Rules relating to trade in services.

17. 3.1 TRADING IN UNPROCESSED AGRICULTURAL PRODUCE Main requirements for trading in unprocessed agricultural goods include: The EAC Rules of Origin An Additional certificate is required to ensure food, animal and human health and safety have been met – Sanitary and Phyto-Sanitary (SPS) measures. “A trader is required to obtain an import license (which confirms SPS measures have been met) from designated agencies before he/she is able to import the unprocessed agricultural produce into another EAC Partner State”

18. 3.2 TRADING IN MANUFACTURED AND SEMI-PROCESSED GOODS Main requirements for trading in unprocessed agricultural goods include: 1. The EAC Rules of Origin; For goods worth US$ 2,000 and above For goods below US$ 2,000 (Simplified Certificate of Origin is issued and used) 2. Product Quality Standards; and 3. Domestic/internal taxes; VAT; and Excise

SECTION 4: TEMPORARY SUPPLY OR PROVISION OF SERVICES The main rules and regulations relating to supply or provision of services are found in Protocol for the establishment of EAC CMP Main rules and regulations are those relating to Free movement of persons/providing/supplying a service for a short period of time (also known as short-term/temporary service suppliers) Key features of temporary/short-term service providers are; The services to be provided are for a short period of time or temporary basis The short-term/temporary service supplier is paid in their home country and it is not necessary for the supplier to live in the country in which the services are provided The short-term/temporary service supplier does not benefit from rights that workers have, such as social security benefits

SECTION 4: TEMPORARY SUPPLY OR PROVISION OF SERVICES “Despite the differences between temporary/short-term service suppliers and permanent workers, there are currently no separate rules in the EAC. The EAC regulations on movement of workers also apply to movement of short-term/temporary service suppliers”

SECTION 5: REGULATIONS ON FREE MOVEMENT OF PERSONS The regulations for free movement of persons include: A valid travel document, i.e. passport or temporary pass document Compliance with immigration procedures e.g. filling in the required immigration forms, and getting the right medical vaccinations such as yellow fever vaccination. Tanzania for example requires that persons entering Tanzania must be vaccinated against yellow fever.

22. SECTION 6: REGULATIONS ON MOVEMENT OF WORKERS The regulations for free movement of persons include: Work permit Required Documents A valid passport; A contract of employment and; Any other document(s) that may be required by authorities

SECTION 7: RIGHT OF ESTABLISHMENT The Protocol for the establishment of the EAC CMP allows: A self-employed citizen of an EAC Partner State, the spouse and children can move and live in another EAC Partner State; A registered company or business to set up a business or company branch in another EAC Partner State. It is however important to note that, a self employed citizen who intends to take up or pursue economic acivities (i.e employment) in another EAC Partner State must apply for a work permit within 30days after entering the other EAC Partner State.
