5 Judicial Review Outcome On 19 May, the High Court gave its judgement on the Judicial Review taken out after Cabinet on 14 March. The Cabinet report on our budget and related matters, had seven recommendations which were approved at the time, however, the Order handed down by the Court quashed six of them relating to:

6 Judicial Review Outcome..quashed the Universal Resource Allocation and the publication of the Citizen’s Statement and the New Offer for Adult Social Care the New Offer for Adult Social Care the proposals for the funds transferred by the NHS under Section 256 of the NHS Act 2006 the adoption of a Universal Resource Allocation System the adoption of the revised eligibility criteria and operational principles the Equalities impact of the above recommendations

7 This means…… this means that our policies are those we had before consultation: – there is a separate RAS for each client group; – therefore Quickheart will not be used as an assessment tool – our eligibility is ‘Substantial’ and ‘Critical’; – none of the new operational principles are approved; – there is no 2011/12 Citizen Statement.

8 Judicial Review Impact The Court did not amend our budget, so we still have a smaller cash envelope to work to. We are assessing this risk and some other already very challenging efficiency targets we have to deliver.

9 Judicial Review Outcome The only recommendation to Cabinet which has not been quashed is: to extend the current arrangements pending the implementation of the Framework contracts

11 The Framework Contract Principals A framework is a general term for agreements with suppliers which set out terms and conditions Specific purchases (call-offs) can be made throughout the term of the agreement. The agreement set out the terms and conditions for subsequent call-offs but place no obligations, in themselves, on the purchaser to buy anything.

12 How the Framework Contract works The Framework will have a pricing mechanism At the award stage, the suppliers to be included on the framework contract will be those who have met the CQC registration criteria The Individual Service Order or Agreement will establish the terms which will apply under the framework, including delivery timescales and payment The length of call-offs, will be appropriate to the purchases in question and should at all times reflect value for money considerations

13 How is the Framework Contract different from current contract arrangements? Prices will not necessarily be fixed, but that there will be a mechanism that will be applied to pricing particular requirements This will be a value for money judgement for the Directorate, taking account of the kinds of purchases involved and the ability to specify such purchases The benefit of the Framework to Providers is a simpler application process, a move to an electronic allocation system and a public portal to citizens in Birmingham both those funded by the Council or self funders

15 Accreditation, the catalogue and quality assurance Potential providers undergo an registration/ accreditation process to gain approval to market their good / service/ activity on the catalogue. Catalogue used to enable people to select their support options from a common source of costed services allowing flexibility, variety and value for money Accredited provider performance monitored via a QA framework including supplier self-assessments, customer feedback and monitor and review. Selected supplier information will be featured on the catalogue to assist citizens in making informed choices.

16 The Catalogue-A Marketing Opportunity All providers will register to have their good/service/activity featured on the catalogue Enhanced marketing opportunities for providers with accreditation status Providing further information on their organisation, for example: – Internal/external quality systems – Professional/trade registration/qualifications – Demonstration of customer satisfaction Adults & Communities quality assurance framework – Supplier self assessments – Customer feedback – Contract performance

19 Proposed Application Process (Community Based) If you completed a PQQ for the Home Support contract and have CQC registration you will be sent a link to the Framework documents and will be required to return the application form by the closing date stated. If you are new to the market, respond to the advert on www.finditinbirmingham.com and you will be sent a link to the Framework documents with a longer version of the application form that is due by the closing date stated.

20 Application Process (Care Homes) This will be advertised at www.finditinbirmingham.com but we plan to send the Framework documents direct to all current Council suppliers. You should complete the application form and return by the closing date stated.

21 Application (General) Owing to the large quantity of applications anticipated and the short time to verify them we request an electronic and a paper copy with any attachments requested. Only return the Application form NOT a signed copy of the terms and conditions
