COUNCIL DECISION on the security rules for protecting EU classified information (2011/292/EU of 31 March 2011) Law on Classified Information and supporting legislation are harmonized with above mentioned regulations

6 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 31 - Foreign, security and defence policy National Security Authority During the international exchange and protection of classified information with NATO and EU, the Directorate for protection of classified information perform the following tasks: 1)security authority for coordination and implementation of NATO and EU security policy in Montenegro, in order to provide adequate level of protection of classified information, in accordance with interstate treaties (NSA-National security Authority) 2) security of communications for selection, management and service of equipment used for transmission, processing and storage of classified information(NCSA National Communication Security Authority) 3) conducting security accreditation of communication and information systems and processes in which classified information are used (SSA- Security Accreditation Authority) 4) control of materials for cryptographic protection of classified information and safe handling, storage, distribution and recording of crypto materials (NDA National Distribution Authority)

13 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 31 - Foreign, security and defence policy INFOSEC Security accreditation shall be issued for the systems where information classified “CONFIDENTIAL“, “SECRET”, and “TOP SECRET“ is processed, transmitted and stored. Security accreditation is valid for 3 years. Crypto protection of communication, information and other electronic systems for composing, transmission, processing and archiving of classified information. Protection from risks of compromising electromagnetic radiation – TEMPEST.

14 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 31 - Foreign, security and defence policy INDUSTRIAL SECURITY In the process of conclusion and implementation of classified contracts ("Confidential", "Secret" and "Top Secret“) legal entities shall hold security clearance – Facility security clearance (FSC) at least equivalent to the level of information contained in Classified Contract. Facility security clearance (FSC) is certificate with which NSA confirmed that legal entities are security cleared for conclusion and implementation of classified contracts (appropriate premises and cleared personnel). Directorate for protection of classified information (National Security Authority (NSA) / Designated Security Authority (DSA)) is only authorized institution for issuing of FSC. Before concluding Classified Contract, Contracting authority shall, as an attachment to the contract, compose instructions on measures for protection of classified information.
