5 Chapter 15: Energy M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 15: ENERGY Euratom Treaty: Euratom Treaty: Nuclear energy development Energy Development Strategy of Montenegro until 2025 year (2007) doesn’t envisage developemnt of nuclear energy (NPP); No nuclear installation exists; no nuclear plant, no other fuel-cycle facility; no research reactor and no other facility for production of radioactive substances (forbidden by the Law on Ionising Radiation Protection and Radiation Safety); Small size of the country with small number of users of radioactive material; Montenegro has very few activities related to ionising radiation and is free of nuclear plants. The use of radioactive materials is limited to the application in medicine, industry, agriculture, training and scientific research (universities), and thus the number of radioactive sources in Montenegro is very low;

6 Chapter 15: Energy M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Regulatory framework related to protection of the health of workers and the general public against the dangers arising from ionizing radiations is established in Montenegro (articles 30-38 Euroatom Treaty). Strategy on Ionizing Radiation Protection, Radiation Safety and Radioactive Waste Management with the Action Plan (2011); National Strategy for Emergency Situation (2006); National Plan of Action in Case of a Radiological Accident (2010); Law on Ionizing Radiation Protection and Radiation Safety ("Official Gazette of Montenegro", No. 56/09, 58/09, 40/11) and 17 implementing regulations Law on transport of dangerous goods ("Official Gazette of Montenegro", No. 5/8, 40/11); Law on Inspection Supervision ("Official Gazette of Montenegro", No. 5/8, 40/11); other horisontal acts (strategies, plans, laws, regulations) Chapter 15: ENERGY Euratom Treaty: Euratom Treaty: Health and safety

7 Chapter 15: Energy M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 15: ENERGY Euratom Treaty: Euratom Treaty: Health and safety TRANSPOSITION There are additional efforts needed for full alignment with provisions from Euroatom Treaty IMPLEMENTATION There is a need for establishment of on-line monitoring system (GDR network), nuclear safety issues,... THE MAIN CHALLENGES Challenges are related both to transposition and implementation. The main implementation challenges are related to significant investments needed for implemetation of goals defined by the Strategy and six (6) IPA 2007 Feasibility Studies supported by the European Commision for further improvement of regulatory infrastructure in Montenegro

8 Chapter 15: Energy M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 15: ENERGY Euratom Treaty: Euratom Treaty: Guarantees for peaceful uses TRANSPOSITION Although Montenegro has no nuclear power reactors or nuclear fuel cycle facilities, nuclear techniques have been used as peaceful use of nuclear energy in the medical field, agriculture, industry and research and science (universities). No iterest for supply of ores and nuclear fuels Regulatory framework infrastructure is established for Safegurad system (inspection, sanctions, accounting) in order to make certain that nuclear materials are not diverted from intended uses IMPLEMENTATION There is a need for establishment of training center in order to strenghten the administrative capacities as well as proffesionally exposed persons, NGO’s, journalists and population Portal monitors THE MAIN CHALLENGES Challenges are related to implementation such as emergencies exercises as well as border control of radioactive and nuclear material. The main implementation challenges are related to significant investments needed for above mentioned.

9 Chapter 15: Energy M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 15: ENERGY Euratom Treaty: Euratom Treaty: External relations Related to external relations as one of forth main fields of action in Euroatom Treaty provisions from ET is significantly transposed within Montenegrin Legal System. Implemention is also in appropriate phase. Towards the adoption of international standards, the total of 15 conventions and agreements in the area of radiation protection, radiation and nuclear safety and security were adopted and published in the Official Gazette of Montenegro in the International Treaties series: Law ratifying the Vienna Convention on Civil Liability for Nuclear Damages (Official Gazette of FRY 005/77); Law ratifying the Convention on Physical Protection of Nuclear Material (Official Gazette of FRY 009/85-309); Decree ratifying the Convention on Early Notification of Nuclear Accidents (Official Gazette of FRY 015/89-3); Convention on Assistance in the Case of a Nuclear Incident or a Radiological Emergency, Vienna (Official Gazette of FRY 004/91-29); Law ratifying the Joint Convention on the Safety of Spent Fuel Management and on the Safety of Radioactive Waste Management(Official Gazette of Montenegro – International Treaties 02/10 of 16.03.2010);

12 Chapter 15: Energy M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 15: ENERGY Euratom Treaty: Euratom Treaty: External relations -Future Plans- After the adoption of Amended of the Law on Ionising Radiation Protection and Radiation Safety, Montenegro will approach to preparation process for ratification: Convention on Nuclear Safety; Amendment to the Convention on Physical Protection of Nuclear Material; ECURIE; Join to EURDEP; to sign with IAEA Code of Conduct on the Safety and Security of Radioactive Sources with the Supplementary Guidance on the Import and Export of Radioactive Sources To enhance regional cooperation

15 Chapter 15: Energy Council Directive 2009/71/EURATOM on the nuclear safety of nuclear installations M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 15: ENERGY TRANSPOSITION Law on Ionising Radiation Protection and Radiation Safety prohibited construction of nucelar installation and assosiated installations and it is not harmonised with this directive. There are four regulations on nuclear safety issues and parts of nuclear safety provisions are transposed in it.  Decision on the requirements for the siting, construction, trial run, commissioning, operation, and permanent shutdown of a nuclear facility (“Official Gazette of the FRY”, No. 42/97) (Chapter V of the Decision is repealed)  Decision on the requirements for trading and use of nuclear materials and the way of record keeping of nuclear materials by material balance zones (“Official Gazette of the FRY”, No. 42/97)  Decision on the procedures and conditions for systematic testing of the presence of radionuclides in the environment surrounding a nuclear facility (“Official Gazette of the FRY”, No. 42/97)  Decision on the requirements to be fulfiled by persons employed in the management of a nuclear facility production process and persons supervising the process (“Official Gazette of the FRY”, No. 2/98) Energy Development Strategy of Montenegro until 2025 year (2007) doesn’t envisage developemnt of nuclear energy (NPP).

16 Chapter 15: Energy Council Directive 2009/71/EURATOM on the nuclear safety of nuclear installations M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 15: ENERGY THE MAIN CHALLENGES Challenges are related both to transposition and implementation and depend on possible revision of the directive, which could take into account a proportionate approach, related to different situation in the various Member States. 17 Chapter 15: Energy M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 15: ENERGY Montenegro takes part in the constructive dialogue aimed for further improvement, to contribute to the global framework of improvement of security and safety. There are 192 countries in the world- Cooperation to help each other to improve security and safety framework is necessary!
