General Information What does it mean to be and undocumented student? ◦ Undocumented students are foreign nationals who came to the United States without legal documentation or overstayed their visas. (Educators for Fair Consideration)

Demographics Children account for 1.8 million or 15% of the undocumented immigrants in the United States. They have had no say in their parent(s)’ decision to enter the and remain in the United States and remain in the United States without proper documentation, but are nevertheless paying the consequences. The majority of undocumented students were brought to the United States by their parents, when they were young children. (University of Texas Austin)

Demographics Every year in the United States, there are approximately 65,000 undocumented students who graduate from high school Only about 5%-10% of these students make it to college. (Gusmano)

House Bill 1079 (HB 1079) Passed March, 7 th 2003 Offers in-state tuition Does not grant or expedite United States citizenship—it is strictly a tuition measure HB1079.org and LEAP

HB 1079 Eligibility Resided in Washington State for the three (3) years immediately prior to receiving a high school diploma, and completed the full senior year at a Washington high school OR Completed the equivalent of a high school diploma and resided in Washington State for the three (3) years immediately before receiving the equivalent of the diploma, AND Continuously resided in Washington State since earning the high school diploma or its equivalent (Affidavit)

DACA Deferred Action for Childhood Arrivals Announced on June 15 th, 2012 Allows undocumented people who came to the United States as youth to apply for temporary deferred action (cannot get deported) and to apply for a work permit for 2 years (USCIS)

DACA Eligibility Born on or after June 16 th 1981 Came to the United States before the age of 16 Have continuously resided in the United States since June 15 th, 2007 (past 5 years) up to the present time Were physically present in the United States on June 15 th, 2012 and at the time of making the DACA application Have good moral character Be 15 years old to file the application (USCIS)

DREAM Act ◦ In 2001, members of Congress introduced the DREAM Act. The full name of this act is the Development, Relief and Education for Alien Minors Act. ◦ This act has been introduced to Congress repeatedly since, but has never been passed. This act would benefit undocumented students in two ways. First, it would make attending college more affordable, and second, these hard working students would be able to apply for citizenship. (Munoz 13) ◦ The last attempt in which the DREAM Act came close to passing was on December 8, 2010; failed to pass by 5 votes (Immigration Policy Center)

The “I” Word Nevins, author of “Operation Gate Keeper and Beyond,” emphasizes that the term “illegal” used to refer to undocumented people in the United States it’s something new (119). Before, undocumented people in the United States were called “unauthorized immigrants,” (140 ) During the 1990s the media started to reflect to undocumented immigrants as “illegals” (140) Today, that is the term that both the media and the government use to define this group of people. (140)
