17 Wireless Support Structure A freestanding structure, such as a tower- based wireless communications facility (WCF) or any other support structure that could support the placement or installation of a non- tower-based wireless communications facility, if approved by the Township. § 200-7 17

18 Non-tower-based WCF All non-tower-based wireless communications facilities, including, but not limited to, data collection units, communications antennas, and related equipment. Non-tower-based wireless communications facilities shall not include support structures for Communications Antennas and related equipment… § 200-7 18

19 Communications Antenna Any structure or device used for the purpose of collecting or transmitting electromagnetic waves, including, but not limited to, directional antennas, such as panels, microwave dishes, satellite dishes and omnidirectional antennas such as whip antennas. “Communications antenna” shall not include tower-based WCFs defined below… § 200-7 19

28 Summary of Code Issues Code limits on tower-based WCFs outside of public right-of-way make the site ineligible for a TOWER- BASED WCF. The site is located in an R-1 zone. §200-39.1 B(1) limits tower-based WCFs to I-1 or UPD Subdistricts 8,9,10,11 zoning. The tower is located 75 feet from an R-1 property line. §200-39.1 B(3) requires it be at least 200 feet from any residential property line. 28

29 Conclusion The Lemont/Cortland Drive site proposal is for the construction of a monopole for wireless communications. The WIRELESS COMMUNICATIONS FACILITIES, TOWER-BASED section of the code regulates this project. We, the neighbors proximate to this site, submit to the planning commission that code requires that section 200-39.1 B., “Tower-based wireless communications facilities outside the rights-of-way,” control the proposed WCF, maintaining the uniform property development that code enforcement promotes. 29
