The UK H&S Legislative Framework
In order to provide an understanding for the citizens of the UK of what are ‘good’ health and safety standards are, the government have created a legislative structure for us to work within. But how aware are you of these standards? Do you know what these standards are? Do you know what is expected of you to comply with these standards? The UK H&S Legislative Framework
So there is a Hierarchy of Legislation associated with H&S in the UK. These set out the standards under which which UK citizens undertaken their activities. This Hierarchy (set of standards) comprises statutory and non-statutory elements. There is a Hierarchy of Courts that exist to deal with making judgements as to individuals practices relative to these H&S standards. I.e. has an individual (or company) met these standards? But what happens if it is deemed that an individual (or company) has not met these standards? Which system of Courts make a judgement on H&S matters? Civil or Criminal? What do you think? Why we need to manage Health and Safety
Having created a ‘framework’ for health and safety for us all to work within, companies and individuals need to manage their activities to meet the standards. We know that if we don’t meet the standards we leave ourselves open for criminal prosecution. But there’s more than just the threat of criminal prosecution; there’s the human cost.
