2. Self-Reporting R277-516-3 ▪ A. A licensed educator who is arrested, cited, or charged with the following alleged offenses shall report within 48 hours or as soon as possible to the licensed educator's district superintendent, charter school director or designee: ▪ (1) any matters involving an alleged sex offenses; ▪ (2) any matters involving an alleged drug-related offenses; ▪ (3) any matters involving an alleged alcohol-related offenses; ▪ (4) any matters involving an alleged offenses against the person under Title 76, Chapter 5, Offenses Against the Person; ▪ (5) any matter involving alleged felony property offenses under Title 76, Chapter 6, Offenses Against Property; and ▪ (6) any matter involving alleged crimes of domestic violence under Title 77, Chapter 36, Cohabitant Abuse Procedures Act ▪ B. A licensed educator shall report convictions, including pleas in abeyance and diversion agreements within 48 hours or as soon as possible upon receipt of notice of the conviction, plea in abeyance or diversion agreement.

3. What Should a Director Report? R277-516-7 ▪ (1)(a) An educator who has reasonable cause to believe that a student may have been physically or sexually abused by a school's employee shall immediately report that belief to the school principal, district superintendent, or UPPAC, in addition to any other reports required by law. ▪ (b) A school administrator who receives a report described in Subsection (1)(a) shall immediately submit the information to UPPAC if the employee is licensed as an educator. ▪ (2) A local superintendent or charter school director shall notify UPPAC if an educator is determined, pursuant to an administrative or judicial action, to have had disciplinary action taken for, or, to be guilty of: ▪ (a) unprofessional conduct or professional incompetence that: ▪ (i) results in suspension for more than one week or termination; or ▪ (ii) otherwise warrants UPPAC review; or ▪ (b) immoral behavior.

4. What Should You Report? R277-515-3 C. Failing to strictly adhere to the following shall result in licensing discipline as defined in R277-515-1G. The professional educator, upon receiving a Utah educator license: … (19) shall be forthcoming with accurate and complete information to appropriate authorities (UPPAC) regarding known educator misconduct which could adversely impact performance of professional responsibilities, including role model responsibilities, by himself or others;

5. What Should You Report? R277-516-3(3) C. The district superintendent, charter school director or designee shall report conviction, arrest or offense information received from licensed educators to the USOE within 48 hours of receipt of information from licensed educators. The USOE shall develop an electronic reporting process on the USOE website.

6. New UPPAC Presumptions ▪ Failure to make a report required under R277-516 is presumed to warrant a Letter of Admonishment, Warning or Reprimand ▪ Failure to report suspected child abuse or sexual abuse to appropriate authorities is presumed to warrant a suspension of up to a year ▪ Aggravating Circumstances may increase penalties
