3 SFY 2015 Stats 22,658 total APS reports 52% of investigated reports were substantiated 9,224 total substantiated 4,171 needed and accepted protective services

6 Trends Reports increased about 4.5% from SFY 2013- 2014 and 2014-2015. Self-Neglect and Neglect account for more than 75% of substantiated cases. Each year, for the past 4 years, APS has substantiated more than 1,000 financial exploitation cases.

9 Reporter Trends

10 Family members are the most frequent reporters. Reports from law enforcement have increased 31% since SFY 2011. Reports from financial institutions have increased 200% since SFY 2011.

11 What’s on the Horizon? State Legislation and Initiatives

12 Continuing Efforts to Streamline Access to Long-term Care The Department of Medical Assistance Services (DMAS) rolled out the statewide ePAS system in July 1, 2015. All preadmission screening UAIs and associated forms are entered into ePAS. Why?

15 2016 GA Session: APS APS reports alleging FE greater than $50,000 shall be reported immediately to local law enforcement (LE). The LE referral may also occur during the course of the investigation. How will this affect APS practice and victims?

16 2016 GA Session: APS HB 676 (Peace). DARS to review substantiated FE cases. Quantify the cost of the FE. Convene a workgroup to recommend ways to address FE. Prepare a report for GA and Governor 1/1/17 We’ll talk more about this....

17 2016 GA Session: Guardianship HB 342 (Pogge) 64.2-2019: Duties and powers of guardian. A guardian shall not unreasonably restrict an incapacitated person's ability to communicate with, visit, or interact with other persons with whom the incapacitated person has an established relationship.

18 2016 GA Session: Auxiliary Grant (AG) Auxiliary Grant will be available in a 3 rd setting in addition to Assisted Living Facility and Adult Foster Care. 3 rd Setting is Supportive Housing. New setting will be capped at 60 individuals. Lots of work to do to get this new setting up and running!

19 2016 GA Session-Other Issues DMAS to study the Alzheimer’s Assisted Living Waiver o Waiver enrollment never reached the cap of 200 individuals. o The waiver may conflict with Federal requirements regarding settings in which Medicaid home & community-based services are delivered.

20 APS Division Initiatives Will have a new position to monitor the AG program—after July 1. AG program has never been monitored. $25 million in expenditures each year— oversight is needed.

21 APS Division Initiatives (cont.) Explore more efficient monitoring of LDSS for AS and APS services. Developing supplemental training for workers. o “APS 101” has been piloted in one region. o Case documentation course. o APS Supervision course.

22 What’s on the Horizon? Federal Legislation and Initiatives

23 Federal Oversight of APS There is no direct federal funding for APS. Most states utilize Social Service Block Grant funds which provides funding to a variety of state and local programs, not exclusively APS. Always a threat this funding may be cut.

24 Funding to Provide Services: There isn’t much! $929,000 (SFY 2015 APS expenditures) 4,171 (people who need protective services) $222

25 Elder Justice Act (EJA) Passed in 2010. Despite passage, funding was never authorized. EJA has expired and needs to be reauthorized.

26 Administration for Community Living (ACL) ACL has an Elder Justice/APS Office but does not oversee or provide direct support to APS programs.

27 NAMRS ACL is developing the National Adult Maltreatment Reporting System (NAMRS). Each state will submit APS data to NAMRS. Will help portray the picture of APS across the country. Why is this important?

28 NAMRS and Virginia APS DARS received $300,000 from ACL to enhance the APS case management system. ASAPS will be replaced by PeerPlace. Several components have been developed. Will make it easier to submit data to NAMRS. DARS will continue to seek funding for project.

29 Victims of Crime Act (VoCA) Federal funding to states to assist victims of various types of crimes. Often designated for organizations that respond to domestic violence and sexual assault. The federal government has released additional funding.

30 VoCA and Elder Abuse In Virginia, Dept. of Criminal Justice Services (DCJS) receives this funding. Will there be additional funding to address elder abuse?

31 Back to HB 676 How can we tackle the problem of financial exploitation of older adults and individuals with disabilities?
