10 Insurance Requirements SOC-3 Owner Controlled Insurance Program (OCIP) Requirements EXHIBIT D and N Cory Mack OCIP Manager, Risk Management

11 Insurance Requirements- Continued OCIP Enrollment is mandatory for eligible contractors Provides following insurance coverage for enrolled contractors while working on the DART project site:  Workers’ Compensation  General Liability  $10,000 Property Damage deductible  Builders’ Risk  $25,000 deductible  Excess Liability  Railroad Protective (if applicable)

12 Insurance Requirements- Continued Contractor-Provided Coverage Evidence of the following coverage must be provided prior to being allowed on the jobsite. All insurance carriers must be rated A- or better by A.M. Best. Automobile Liability (off-site & on-site) - 2,000,000 Combined Single Limit Workers’ Compensation (enrolled off-site only) - Statutory Benefit - Employers Liability - $500,000 Commercial General Liability (enrolled off-site only) - $1,000,000 per occurrence - $2,000,000 general aggregate Waiver of subrogation and additional insured as outlined in Exhibit D

13 Insurance Requirements- Continued Responsibilities of Contractors Prior to beginning work onsite: - OCIP enrollment (DART Form 2, required Certificate of Insurance with endorsements, WC, CGL and Excess Liability declaration, schedule & rate pages) - Exclude any costs for insurance provided by the OCIP in pricing schedules as outlined in the OCIP Manual. - Safety/Security – badging, safety orientation, HCN Payroll Reporting – monthly (10 th of month) Timely Claims Reporting – within 24 hours of incident Enforce Compliance of all lower tier subcontractors

14 Exhibit F Provides all standard contract clauses: –Changes –Disputes –Warranties –Payments –Pricing Adjustments –Termination for Default/Convenience
