1 PEACHTREE HILLS ROAD WAIVER REQUEST  2.34 ± acres  Currently zoned R-1a  Proposes to create 2nd lot (Mesa Village Tracts No. 2, Replat No. 1)  Applicant requesting no road improvements to 275 ± linear feet along Peachtree Hills Road

2 CASE SPECIFICS  Peachtree Hills Road has 26 ± foot ROW with double penetration surface on the county side  Requires 100-ft ROW  Applicant will dedicate additional 50-ft on south side of Peachtree Hills Road  Dedication will occur with the replat (final plat)  Peachtree Hills Road is classified as a Minor Arterial  Applicant is required to build pro-rata share  Applicant was advised during the review process for the proposed lot split that road improvements would be required  Final mechanism for road improvements is final plat and construction drawings  Article II of CLC Design Standards  Road improvements required on streets adjacent to a subdivision or property boundaries as indicated by street classification…the subdivider shall provide the street improvements or pay for the cost of these improvements

3 PRO-RATA SHARE REQUIREMENTS: ONE-HALF OF STREET SECTION INCLUDES TWO TRAVEL LANES, ONE BIKE LANE, ONE SIDEWALK, CURB/GUTTER

4 CRITERIA FOR WAIVER REQUESTS LCMC Ch 36 – Subdivisions –Article IX Waiver of Regulations Waivers may be granted for substantial hardship Substantial hardship is defined as a result of exceptional topographic, soil, or other surface or sub-surface conditions or that such conditions would result in inhibiting the objectives of this code. –Subdivision Code does not specify a financial hardship as a criterion for granting a waiver to the requirements of the Subdivision Code.

5 REVIEW PROCESS DRC recommended denial of the waiver request based on current City policy –Comprehensive Plan – Transportation Element –LCMC Ch 32 – Design Standards –LCMC Ch 37 – Subdivision Code Planning & Zoning Commission recommended approval of the waiver request due to financial hardship City Council is final authority on waiver requests

9 CITY COUNCIL OPTIONS 1.Vote “YES” to approve the Resolution. Waiver request is granted. CLC would need to explore alternative methods to fund future improvements to Peachtree Hills Road. 2.Vote “NO” to deny the Resolution. Applicant will be required to provide pro-rata share of road improvements to Peachtree Hills Road. 3.Modify the Resolution and vote “YES.” 4.Table/Postpone the Resolution and direct staff accordingly.
