3 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union  Montenegro has not transposed the Directive 2009/12/EC of the European Parliament and of the Council of 11 March 2009 on airport charges.  The Law on Air Transport of Montenegro from 2012, Article 56, Paragraph 8, defines that the Ministry of Transport and Maritime Affairs of Montenegro shall prescribe the criteria and methodology for determining the amount of airport charges. The adoption of this act is planned in the fortcoming period.  The same Law, Article 56, prescribes the following:  Paragraph 1 – Airport operator is entitled to compensation for the following : 1.Handling of aircraft, passengers, baggage, cargo and/or mail; 2.Services of passengers and aircraft; 3.Use of airport infrastructure; 4.Landing and parking of aircraft; 5.Services of illumination of maneuvering areas in the conditions of low visibility; 6.Services of land administration and supervision; 7.Airport service; Air Transport – AIRPORT CHARGES Chapter 14: TRANSPORT POLICY

4 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Air Transport – AIRPORT CHARGES Chapter 14: TRANSPORT POLICY  Paragraph 2 – The level of the airport charges depending on the quality of service provided shall be determined by the airport operator on non- discriminatory basis, after consultation with the airport users.  Paragraph 3 – The level of the charge for a particular service shall be determined by the airport operator on the basis of actual costs.  Paragraph 4 – The following shall be exempted from the airport charges: 1.Aircrafts involved in search and rescue operations; 2.Aircrafts used for humanitarian assistance in case of a natural disaster or state of emergency; 3.Aircraft in distress; 4.State aircraft and foreign state aircraft under condition of reciprocity;  Paragraph 5 – The level of the airport charges shall be determined by the airport operator, with the previous consent of the Ministry of Transport and Maritime Affairs.  Paragraph 6 – The airport operator is obliged to advise all airport users which use its services of the amount and reasons of the charges change, not later than 60 days before the planned due date for payment for the said services.

5 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Air Transport – AIRPORT CHARGES Chapter 14: TRANSPORT POLICY  Paragraph 7 – At least once a year, the airport operators have to deliver information about the collection of airport charges to the Ministry of Transport and Maritime Affairs and Civil Aviation Agency (CAA).  After taking over airports in Podgorica and Tivat in 2003, Public Enterprise Airports of Montenegro defined the level of airport charges on the basis of actual costs and the same experience of the airports which are of the similar size and those airport charges are the most competitive in the region and beyond.  The levels of airport charges for both airports is defined by Public Enterprise Airports of Montenegro price list which is transparent and available to all current and future users on web page www.montenegroairports.com. www.montenegroairports.com  Apart from the price list, Public Enterprise Airports of Montenegro has developed incentive scheme, which is transparent and non-discriminatory for all current and future airport users regarding the introduction of new destinations and the increase of frequency and traffic volume.

6 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Air Transport – AIRPORT CHARGES Chapter 14: TRANSPORT POLICY  The level of the airport charges has been the same since 2003 to the present day notwithstanding the implementation of the large-scale projects comprising the extension, reconstruction and modernization of infrastructural capacities, which were completed in the mid-2006.  When starting operations on Podgorica and Tivat airports, Public Enterprise Airports of Montenegro inform every airport user about the Public Enterprise Airports of Montenegro price list and incentive scheme.  During the period of contracting the services and the quality service level, as well as during the period of providing the services, none of users on both airports had no objection to the level of the airport charges.

9 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Air Transport – AIRPORT CHARGES Chapter 14: TRANSPORT POLICY  Last month the Public Enterprise Airports of Montenegro completed its new price list, which is not modified in the part relating to the level of airport charges, but only harmonized with national and international regulation in terms of analysis and different classification of types of compensation which have been charged so far from the airport users but in another form.  A new form of Public Enterprise Airports of Montenegro price list will be submitted by the end of May 2013 for the approval to the Ministry of Transport and Maritime Affairs in accordance with Paragraph 5, Article 56 of the above mentioned Law.  Based on the Ordinance on amending the Ordinance on ground handling adopted in March 2013, Public Enterprise Airports of Montenegro will form the Airport Users Committees at both airports by the middle of September 2013, in order to create all preconditions for implementation of Directive 2009/12, on the respective airport immediately after transposing it into national regulation.  Number of handled passengers at Tivat Airport in 2012 was 725 392.  Number of handled passengers at Podgorica Airport in 2012 was 639 352.
