COLLECTIONS Collections is the enforcement of debt payment. Collection action may include: Garnishee orders Liens Judgement Seizure of assets Set-off Foreclosure Pursuing third parties

Section 130 of the Forest Act CERTIFICATE OF JUDGEMENT: Acts as a certificate with the same force and effect as a court ordered judgement. Provides for the use of other collection remedies such as liens and writs of seizure and sale. Can be registered against individuals, corporations, partnerships, etc. Can be registered against the licensee and or third parties that are deemed to be liable for debts owed to the Province. Used when voluntary compliance has failed or when additional security is required by the Province.

Section 131 of the Forest Act PERSON ACQUIRING OR DEALING IN TIMBER RESPONSIBLE FOR PAYMENT: You must report your transaction or dealing within 10 days of the event occurring. You must pay the stumpage or royalty on the portion of the timber you acquired, dealt with, or handled as required under the Act or under the agreement entered into under the Act. Failure to do so may result in collection action against you if the Province fails to obtain payment from the licensee. The Province will attempt to contact you by phone, email or letter to advise you of our intention. The same tools and legislation used to collect from the licensee can be used against a third party.
