14 If you knowingly transmit HIV, can you go to jail?

15 Anthony E. Whitfield, December 2004: Lacey, Washington Whitfield was sentenced to an unprecedented 178 years in prison by a court in the state of Washington after exposing 17 women to HIV and infecting his wife and four others GUILTY – 7 counts of first-degree assault with sexual motivation  Whitfield is one of around 150 people to have been convicted of criminal HIV transmission in the US

16 Nadja Benaissa; August 2010: Germany, 28-year-old pop singer First arrested in April 2009, following complaints registered by three men she had sex with between 2000-2004 that she had not disclosed her HIV status – One of these men had since tested positive for HIV. In August 2010 she was rearrested and appeared in juvenile court (as the first alleged crimes took place when she was 17), where she confessed to having unprotected sex and apologized for the harm caused. – “In those days I was careless...I'm sorry from the bottom of my heart", she told the court. On the 23rd of August 2010, Benaissa received a 2-year suspended sentence – Infecting someone with HIV in Germany is an offence that carries a prison sentence of six months to 10 years

17 Cecelia Sliker; October 2008: An HIV-positive Florida mother became the first US women to be successfully prosecuted for mother-to-child transmission after she was found to have not taken steps to minimize the risk of her second son, born in 2004, becoming infected. In pleading guilty, Sliker was sentenced to two years' probation, avoiding a maximum 15-years in prison, as it was deemed imprisonment would prevent her caring for her son in future. Sliker had known she was HIV positive before the birth of her first son in 2001, and had taken steps to prevent him becoming infected.

18 HIV transmission cases have been brought to court under aggravated assault laws whereby a person “intentionally, knowingly, or recklessly…uses or exhibits a deadly weapon as part of an assault”. Saliva of an HIV infected person is considered a deadly weapon – New HIV tests use saliva to test for HIV Texas Law

19 Who’s been sleeping in my bed? The Story of Bill & Monica

20 Bill was a freshman in college. He had been going out with Monica since their junior year of high school. They began having sex a few months after meeting each other. Both of them were virgins. They were in love and wanted to be responsible so Monica went to the clinic and went on the pill. In the 2 years they have been going out, they have been faithful to each other….until the other night.

21 Bill went to a fraternity party and got pretty drunk. He met this girl Allison who was visiting from another state. One thing led to another and they would up having unprotected sex. Unknowingly, Bill also became infected with HIV that night.

22 When Bill went home for the weekend, he felt guilty, but didn’t say anything to Monica. Since Monica had been on the pill, they had unprotected sex that night and HIV was passed onto her. Although they are both infected, they look and feel perfectly healthy.

23 Several months later, Bill’s conscience got the best of him and he told Monica about his one- night stand. She was devastated and broke up with him. Two years have gone by since then. During that time….

24 Bill has had sex with two girlfriends, Debbie and Rachel. He also had sex with a one-night stand name Christina.

25 Since then, Christina has had sex with Patrick.

26 Debbie has had sex with her new boyfriend Darrel.

27 Darrel is a body builder and has recently started injecting steroids. He has been sharing his needles with his workout buddy Dominick.

28 Dominick then had sex with his girlfriend, Laurie.

29 Rachel has had sex with a guy named Rocky and another guy Victor.

30 Monica has only had sex with one other person, her fiancée Chad.

31 Questions Who has HIV? Who started the spread of HIV? Line up in order: Allison, Bill, Monica, & Chad Have Allison & Chad ever met? How did Chad get HIV?

32 Critical Points STDs spread extremely fast If you are having sex, you are exposing yourself to STDs When you have sex, you are having sex with everyone that person has ever had sex with Condoms only REDUCE your risk of STDs, you are not protected and it is not safe
