PricewaterhouseCoopers Study on the new regulation on driving and rest time and its impacts regarding the deletion of the "12 days exception" for busses October 19th, 2007 Page 2 Project objectives The issue: Regulation N. 561/2006: Deletion of the exception for “international carriage of passengers, other than on regular services” which existed in the old regulation. 1.To give an overview of the economic situation and the characteristics of the bus and coach tourism sector affected by the new regulation 2.To provide a detailed impact assessment as regards the deletion of the 12 days rule. Analysis will be developed in relation to the following issues: a)bus and coach tourism b)competitiveness of the industry c)road safety 3.To assess the new regulation's impact on the business viability of SMEs and in rural areas - in particular as regards a potential shortage of drivers caused by the provisions of the new regulation. 4.To draw and summarise conclusions, with regard to: a)appropriateness and proportionality of rule b)recommendations in case of evidence of significant negative effects

PricewaterhouseCoopers Study on the new regulation on driving and rest time and its impacts regarding the deletion of the "12 days exception" for busses October 19th, 2007 Page 4 Sector Overview and data Analysis (Task I and II) INPUT Overview of the legislative framework Literature review on characteristics of the bus and coach industry in the international carriage of passengers, other than regular services. ASSESSMENT: Reorganise relevant data in relation to the following areas: - company profiles and sizes; - relevant coach tourism products and destinations of coach tourism trips; - share of trips longer than six days; - difference between companies in different EU-member States; - profit margins and costs (especially costs for personnel); - particular problems of the sector.

Synthesis of stakeholders’ ad hoc interviews. The survey is carried out using a questionnaire “scheme”. The Study will include: Overview of the European bus and coach tourist industry with specific focus on the international passenger transport.

PricewaterhouseCoopers Study on the new regulation on driving and rest time and its impacts regarding the deletion of the "12 days exception" for busses October 19th, 2007 Page 6 Impact Assessment (Task III) Impact assessment analysis in relation to the elimination of the “12 days rule” in terms of: Economic impacts Social impacts Safety impacts The Study will include: 1. Definition for each issue of the: –main advantages/disadvantages in terms of sustainability (economic, and social); –estimated direct costs and benefits ; –impact on competitiveness and sector development in Europe. 2. General assessment at the EU level; more detailed assessment related to the case study. 3. Qualitative analysis will be presented to assess main issues and impact of the new legislation for the sector.

The Study will include conclusions, with regard to: a)appropriateness and proportionality of rule b)recommendations

Final report and study will be completed by PwC by the end of the year. The study will be disseminated formally not before the end of January after EP’s approval.
