Dred Scott ~ Background 1. A Missouri Slave (slave state) 2. Years earlier he traveled to Wisconsin (free state) w/t his Master. 3. When returned to MO, went to court to win his freedom. 4. Argued that his stay in WI made him a free man & won.

Dred Scott ~ Supreme Court Case 1. 9 Justices on Supreme Court, 5 were from the South. 2. Question #1: “As a slave was Dred Scott a citizen who had the right to bring a case before a federal court?” 3. Question #2: “Did his time in Wisconsin make him a free man?”

Dred Scott ~ Supreme Court continued… 1. Chief Justice Robert Taney wanted to settle the controversy over slavery. 2. He asked the court to consider 2 more questions: Question #1: “Did Congress have the power to make any laws at all concerning slavery in TERRITORIES?” 3. Question #2: “And, if so, was the Missouri Compromise a constitutional use of that power?”

The Dred Scott Decision 1. By a vote of 5 to 4, the Court decided Scott couldn’t sue for his freedom in a federal court b/c he wasn’t a citizen and never would be one. 2. The MO Compromise was unconstitutional, so his stay in Wisconsin meant nothing. 3. Slaves are property according to 5th Amendment and you cant take away property from owner. (FYI) don’t write down: - 5th Amendment says property can not be taken away from people without the due process of law (a proper court hearing). - Congress had a constitutional responsibility to protect property rights of slaveholders.

Defendant’s Attorney ~ you are defending the defendant. 6. Witness #1: defending Dred Scott 7. Court Reporters: you can only take notes or sketch what is going on in the court room. (No pictures) 8. Chief Justice Roger B. Taney ~ Head of the Supreme Court 9. Supreme Court Justice ~ you make the decsion for this case.
