All parties being rated should be made aware of this, and concerns or problems should be dealt with throughout the project. Do not wait until the end of the project to inform individuals of problems or concerns. Bring them up to allow for corrections. PERFORMANCE RATING

Architect/Engineer Services Small Purchases of Services 53A-20-101… If the procurement of the services is estimated to exceed $80,000* then the Statement of Interest and Qualification [SOIQ] shall be used. *NOTE: Purchasing Administrative Rule R33-5-530 requirement of $100,000 is overridden by this more restrictive specific law for schools.

ADVICE – OPEN MEETINGS LAW MEETING WITH DESIGN PROFESSIONALS OR CONTRACTORS IN A CLOSED BOARD MEETING TO DISCUSS “trade secrets, proprietary issues, other issues related to construction, facilities, and so on” IS NOT ALLOWED. THEY CAN’T BUY THE BOARD LUNCH OR DINNER EITHER.

ADVICE – OPEN MEETINGS LAW USOE legal counsel has indicated that these type requests do not meet the purposes of closed meetings. Any materials provided during any meetings would be subject to GRAMA. The company can’t have both the satisfaction and convenience of a public presentation and the protection of their ideas, plans, processes. Just the price of doing business with the public.

Utah State Purchasing RFP MANUAL http://purchasing.utah.gov/forms/index.html Fee proposals shall be evaluated objectively and independently from the qualitative proposal. Best Practice: Price = 40%, but shall not be less than 30%. Evaluation criteria shall be weighted to reflect the priority of the information asked for in an RFP... while following the Division of Purchasing guidelines, including the State Purchasing’s RFP Manual & R33-3-201 to 217.

Retention: 53A-20-101 (6) (a) A local school board may require in the proposed contract that at least 10% of the contract price be withheld until the project is completed and accepted by the board.
