Chapter 19: Social Policy and Employment M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 19: SOCIAL POLICY AND EMPLOYMENT Poverty in Montenegro -Statistics- According to the Census of Population, Households and Dwellings in 2011 Montenegro has a population of 620,029. The poverty rate in Montenegro: 2009 - 6.8% 2010- 6.6% The absolute poverty line for Montenegro: In 2009 amounted to 169.13 and in 2010 – 169.98 € In 2011 -175.25 € In 2011, 9.3% of the population had an equivalent consumption below the absolute poverty line. Statistical Office of Montenegro plans to conduct regular survey EU SILC (Statistics of income and living conditions) in April 2013. Montenegro constantly strives to decrease poverty, and reduce to a minimum the harmful effects it brings.

Chapter 19: Social Policy and Employment M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 19: SOCIAL POLICY AND EMPLOYMENT The Field of Social and Child Protection Normative framework: The Constitution of Montenegro ("Official Gazette of Montenegro", no. 1/07) Law on Social and Child Protection ("Official Gazette of RoM", no. 78/05) Family Law ("Official Gazette of RoM", no. 1/07) The Law on Social and Child Protection stipulates: that the goal of social welfare and child protection is the provision of care for families, individuals, children at risk and those in social need, i.e. social exclusion. In achieving the objective, the particular protection enjoy incapable to work, financially unsecured, children without parental care, children with physical, mental or sensory disability, abused and neglected children, children with behaviour disorders, persons with disabilities, the elderly, individuals and families in need of appropriate form of social protection due to special circumstances (Article 4). that in the exercise of social and child welfare citizens are equal, regardless of nationality, race, sex, language, religion, social origin, or other personal characteristics. (Article 5).

Chapter 19: Social Policy and Employment M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 19: SOCIAL POLICY AND EMPLOYMENT The Field of Social and Child Protection The basic rights from the child protection: - Equipment for the newborn child; - Allowance; - Fee based on the child's birth; - Compensation of salary for part-time work; -Holiday and recreation for children (Article 43) Family Law regulates family placement (foster care Article 162) Adjustment of fees under the rights of social welfare and child protection shall be conducted at the proposal of the Ministry of Labor and Social Welfare with prior approval of the Ministry of Finance. Social and child care is financed from the state budget.

Chapter 19: Social Policy and Employment M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 19: SOCIAL POLICY AND EMPLOYMENT Reform of the Social and Child Welfare System Project “Reform of the Social and Child Welfare System: Improvement of the Social Inclusion” is implemented through the EU funds (IPA 2010). Partners in the project are the Ministry of Labour and Social Welfare, Ministry of Education and Sport, i kancelaand offices of the UNDP and UNICEF in Montenegro. The goal of this project is to facilitate the access of the vulnerable, socially excluded groups of population to the comprehensive, inclusive, and sustainable services based on family and community.

Chapter 19: Social Policy and Employment M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 19: SOCIAL POLICY AND EMPLOYMENT The Field of Social and Child Protection The "Social Card" project The Government of Montenegro and UNDP signed an agreement on cooperation within the project "Social Card" Objectives of the Project: Improvement of the capacity of the Government of Montenegro to plan and monitor, track and manage social protection; To support the reform of social and child protection; To convince donors interested in financing in the social assistance system to channel their support (aid or services) towards the poorest. In order to improve financial position of disadvantaged population groups the following programs are being implemented: 1. Program of subsidizing bills for electricity to the most vulnerable population 2. Program to provide free textbooks

Chapter 19: Social Policy and Employment M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 19: SOCIAL POLICY AND EMPLOYMENT Health Care Field Normative framework: The Constitution of Montenegro ("Official Gazette of Montenegro", no. 1/07) Law on Health Protection ("Official Gazette of RoM", No. 39/04 and "Official Gazette of Montenegro", No.14/10); Health Insurance Law ("Official Gazette of RoM", No. 39/04 and "Official Gazette of Montenegro", No.14/12); The Law on Protection of Population from Communicable Diseases ("Official Gazette of Montenegro", No.32/05 and "Official Gazette of Montenegro" No. 14/10 and 30/12); The aim of the Law on health protection, among other things, is to create the conditions for: -ensuring access to health care on equal terms to all citizens of Montenegro -a special concern for the health and socially vulnerable categories of population (Article 2). According to the Law on health insurance, policyholders who receive health care at the expense of insurance are, among other categories, also users of social protection rights, in accordance with special regulations (Article 8)

Chapter 19: Social Policy and Employment M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 19: SOCIAL POLICY AND EMPLOYMENT The field of employment National Strategy of Employment and Human Resources Development 2012-2015 aims to create better conditions for job creation and in parallel the investment in human capital, in order to raise the level of employment, which will eventually lead to a reduction in poverty. One of the priorities is to promote social inclusion and poverty reduction. Planned activities: Implementation of the National Strategy of Employment and Human Resources Development 2012-2015 - Improving the system of social benefits and services in order to better focus on and cover vulnerable groups Integrating in the Employment of People with Disabilities, RE population, refugees and displaced persons integration in employment

Funds to finance the education system are provided by the state budget.

Normative framework: The Constitution of Montenegro ("Official Gazette of Montenegro", no. 1/07) Law on Social and Child Protection ("Official Gazette of Montenegro". No. 78/05) Law on Pension and Disability Insurance ("Official Gazette of RoM", no. 54/03... "Official Gazette of Montenegro", no. 66/12) Law on Health Protection ("Official Gazette of RoM", no. 3 9/04 and "Official Gazette of Montenegro", No.14/10); Health Insurance Law ("Official Gazette of RoM", No. 39/04 and "Official Gazette of Montenegro", No.14/12); Family Law ("Official Gazette of Montenegro“, No. 1/07) Law on Social and Child Protection - especially protects the elderly (Article 4) - The law established the following basic rights to social care of the elderly: family allowance, personal disability allowance, care and assistance of another person, placement in institutions, foster placement, health care, funeral expenses and one-off financial assistance (Article 12)

Approach at the national level in priority areas: Access to education Access to Employment Access to social and health care Access to housing

Chapter 19: Social Policy and Employment M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 19: SOCIAL POLICY AND EMPLOYMENT Access to education Programs of inclusion of RE children are continuously conducted at all levels of education: Preschool education - in the Capital city operates unit attended by children of RE population located in the settlement with larger number of RE population. Number of Roma and Egyptian children in primary education has steadily increased ( in 2001/02 - 536 children – and in 2012/13- 1853 children). High school -all students -30 children get scholarships amounting to 70.00 euros All students - 8 are provided scholarships – 150 euros Implementation of educational programs for adults - freed of costs to acquire primary education and the first qualification. Continuously conducted a number of projects aimed at: Dropout prevention, training of teachers, reducing the language barrier, the elementary education, vocational training and others that contribute to the process of social inclusion.

Programs: Literacy and vocational training Education and training for the first job Employment at the local and state level Training for the acquisition of first occupation Education of Roma and Egyptians Improving the capacity and raising the level of knowledge of the staff at the Agency of Employment and other programs

Chapter 19: Social Policy and Employment M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 19: SOCIAL POLICY AND EMPLOYMENT Access to social and health protection Projects in the field of social and child protection and health promotion: "Child allowance for REA Kosovo" "Adequate social protection is better integration” "Raising awareness of health care for Roma" "Prevention of infectious diseases in Roma" "Raising awareness of REA children and young people about the harmful effects of psychoactive substances on mental and physical health of a person", and others. Program of acquisition of free textbooks (Ministry of Minority and Human Rights, MLSW and MJ) Activities in the Capital city of Podgorica: One-off help – in money or in kind; Free meal a day- 500 meals a day, 60% of the users are members of the Roma population Financial assistance for the purchase of textbooks and school supplies, etc...

Chapter 19: Social Policy and Employment M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 19: SOCIAL POLICY AND EMPLOYMENT Access to housing Through appropriate projects in the past, in cooperation with international organizations and local governments are resolved some of housing issues Built about 100 housing units in the municipalities where the RE population lives.

Chapter 19: Social Policy and Employment M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 19: SOCIAL POLICY AND EMPLOYMENT Access to social and health care, education, employment and housing Planned activities: Implementation of the project "Identification of durable solutions for internally displaced persons and residents of Konik camp" phase I of the IPA 2011 The project consists of two components: Construction of 90 residential units; Social integration (access to employment, education and personal documents). (Budget 3,000,000e) Implementation of the project "Identification of durable solutions for refugees and internally displaced persons and residents of Konik camp” -Phase II, the IPA 2012-2013. The project is related to social integration (employment, education and health care). (Budget 1,112,000 e)

Chapter 19: Social Policy and Employment M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 19: SOCIAL POLICY AND EMPLOYMENT Access to social and health care, education, employment and housing Planned activities: Implementation of Strategies for improving the position of Roma and Egyptians in Montenegro 2012-2016 Implementation of the Action Plan for implementation of the Strategy for resolving the issue of refugees and internally displaced persons in Montenegro, with special emphasis on the Konik camp Implementation of the Regional Housing Project - Sarajevo Process / Belgrade initiative for Displaced Persons and Internally Displaced Persons. This project has foreseen construction of 1,177 housing units (for the most vulnerable groups) The project is worth about 27 million euros: It is envisaged that 23 million euros are provided through grants and 4 million euros to be national contribution. The adoption of the Law on Social Housing in 2013.
