© International Road Transport Union (IRU) 2009 Page 8 IRU / FTA Joint Seminar Session III. ‘Cooperation and Principles in Enforcement’ EU enforcement can no longer remain a mosaic of national practices, disjointed sanctioning and non-aligned penalty systems. A quantum leap forward is needed to bring the current situation up to an acceptable level of consistency and predictability across the EU. The road transport industry accepts that operator risk rating systems and information exchange between control bodies for the purposes of intelligence led enforcement is necessary to help harmonise and improve the efficiency of controls. Information flows both between national enforcement authorities and towards domestic and foreign operators should be improved. This should include information on rule changes, as well as new enforcement practices and requirements. A Member States information point on national enforcement practices should be established until such a time as there is full harmonisation of control techniques. National enforcement bodies and operators should have a joint stake in shaping how controls are to be conducted. Official consultation and dialogue is required to ensure that the needs of both parties are taken into account. At minimum operators and enforcers should agree codes of conduct containing best practices to be observed by both. These could include commitments to: minimise the duration of controls with reference to average inspection times; suitable locations for where controls take place; identification of a roadside control priority checklist (e.g drivers’ weekly rest, vehicle road worthiness and road safety issues) that should be given more attention lesser issues; acceptance of credit card payment for fines; immobilisation only in circumstances where road safety is seriously put at risk. The best use of modern technology should be used to improve controls and their efficiency.
