3 Background on Tanggol Kalikasan non-stock, non-profit and non-governmental organization involved in public interest environmental lawyering in the Philippines incorporated as a fully independent organization in January 2001 after 13 years as the environmental law office of Haribon Foundation

4 Vision and Mission The organization envisions an empowered society that relates with its environment in a just and sustainable manner for the equitable benefit of all Filipinos. Its mission is to facilitate the empowerment of communities and institutions to manage their ecosystem through law and other creative mechanisms.

8 Project Goal The project aims to strengthen environmental law enforcement capacity by engaging and facilitating the training of stakeholder communities (the barangay), environmental law enforcement officers (the badge), lawyers and prosecutors (the bar) and the adjudication service (the bench); and facilitating the provision of technical and legal support to environmental enforcement officers.

18 Strengthening Multi-Agency Task Forces (a)development of enforcement procedures/protocols for environmental law enforcement groups (b)other policies and guidelines in support of enforcement of environmental law

19 Strengthening Legal Support Formation of environmental lawyer’s network to handle environmental cases, prosecute persons charged with environmental crimes, or to help defend enforcement officers facing harassment lawsuits.

20 Compliance promotion through the mass media (a)the conduct of tri-media orientation and media conferences, (b) formation of Tri-Media Groups, (c) production of video documentaries, (d) release of alerts, bulletins and press releases related to enforcement and compliance promotion, and (e) media visits and press briefings.

23 Project Areas 13 municipalities and 3 cities surrounding Taal Volcano Protected Landscape, 3 municipalities surrounding Seven Lakes of San Pablo, Buhi, Camarines Sur, 10 municipalities surrounding Mt. Banahaw-San Cristobal Protected Landscape, and 25 selected protected areas and watersheds in Luzon

24 Project Objectives Improve management and governance of the critical ecosystems due to sustained law enforcement support and activities Improve stakeholders’ participation and strong partnerships among local government units, government agencies and civil society groups in the primary target areas, as well as firm regulation of lake users Enhance skills of the PASUs and ecosystem managers, share experiences through mechanism for skills sharing

25 Environmental Law Enforcement Action Planning

26 Background Convened by DENR and the National Law Enforcement Coordinating Committee-Sub- Committee on Environment and Natural Resources (NALECC-SCENR) 1 st National Environmental Law Enforcement (NELE) Summit on August 21-23, 2006 2 nd NELE Summit and Orientation Workshop on Environmental Laws on November 18 to 20, 2010 National Environmental Law Enforcement Action Planning Workshop on June 1-3, 2011

27 1 st ELE Summit The summit results have outlined a roadmap for environmental law enforcement in the next five years. The roadmap identified the following activities in the list of top priorities: a) development of standard enforcement protocol; b) development of standard training program; and c) development of mechanism for incentives and protection of enforcers

28 2 nd ELE Summit Identified the challenges in environmental law enforcement, the factors that contribute to an efficient law enforcement, and the recommended next steps to be taken to address the issues and challenges

29 ELE Action Planning Action plan formulated that will set the direction for the environmental law enforcement in the country within an agreed period; tasks and responsible agencies were identified, including the needed logistics and their possible sources Workshop aimed at developing a training curriculum or program for environmental law enforcers conducted

30 Objectives For the country to have a standard regular training program for the PNP and other law enforcement agencies on environmental law enforcement. For the country to have a sustained environmental law enforcement operations by the inclusion of these items in the Work and Financial Plan of all concerned agencies.

31 Objectives For the country to have a uniform, comprehensive and systematic procedure in the implementation and enforcement of environment and natural resources laws (fishery, environment and mining, forestry) For the country to have a national database of environmental cases filed in court for monitoring purposes

32 Objectives For the country to have a strengthened coordination between and among the law enforcement agencies, the DOJ, the judiciary, the local government units and the IBP. The latter is for the defense of law enforcers subjected to harassment suits.

33 Objectives For the country to have a comprehensive and functional system of protection and incentives for our environmental law enforcers. This includes the following: a. protection for whistle blowers; b. reward system for informants; c. reward or incentive system for enforcers; d. life and accident insurance system for law enforcers.

34 Objectives To develop a standard IEC plan, including the use of tri-media on environmental law enforcement
